On October 8, 2024, in the case of Power Home Remodeling, Inc. v Matthew Hess (WCAB,) the Commonwealth Court affirmed the WCAB and the WCJ in finding that the significant injuries sustained by the Claimant in an ATV accident were sustained in the course and scope of employment, and that the Claimant had given notice to the Employer as required by the Act. Although the case is very fact specific, the lesson to be learned is that the WCJ may pick and choose what facts he relies upon in rendering a decision, and the WCJ ultimately determines credibility. Those findings may not be disturbed or reversed on appeal, regardless of how slanted they may be. In this case, Claimant signed out that he would be on vacation. He went to West Virginia with two co-workers and a third person. This was his third trip with the same individuals. He did not book the trip through the company’s Special Events Department. He did not use his company credit card to pay for expenses and his wife completed an application for STD benefits, stating that the Claimant was “off job.” The Claimant was able to offer an explanation for each of these issues which the judge found to be credible. The judge found that the Claimant was building comradery and recruiting a new employee and was therefore within the course and scope of his employment. Regarding notice, the Employer flew Claimant’s wife to the hospital and therefore was obviously aware of the injury and its relatedness to employment. The two lessons to be learned are that generally the more serious the injury the more compensable it becomes because the Claimant is sympathetic. Secondly, never rely on any WCJ to control the destiny of your claim. As the Employer, Carrier or TPA, you need to control the destiny of your claim. #workerscomp #credibility #claims

The past couple of months have been epic for Aegis Living. In my previous role, I had access to an insurance plan covering his specific medication, albeit with a higher deduction from my paycheck. When I was laid off and switched to COBRA at $1800 per month for my family, I managed with severance and other income sources. However, during #jobhunting, I realized the necessity of discussing benefits, a practice frowned upon by some #employers. I advocate for changing this norm and normalizing benefit discussions.
