Arbitration has emerged as a prominent method for resolving commercial disputes in Kenya, offering an alternative to the often protracted and costly litigation process in courts. It offers a valuable alternative for resolving commercial disputes in Kenya, combining efficiency, expertise, and confidentiality. The legal framework, underpinned by the Arbitration Act of 1995, provides a robust structure for fair and effective dispute resolution. However, parties must weigh the advantages against potential challenges to determine if arbitration is the most suitable method for their specific dispute. This seminar initiative in Malawi is an example of the impact of capitalist ownership on legal processes in developing countries. The Morgan Group, owning both the legal firm and the article's text, uses its power to advance its interests and strengthen its position in this region. The seminar conducted by London partners and a lawyer from the Morgan company aims to educate and bolster the positions of local officials and specialists in commercial disputes and arbitration. However, despite the stated goal of assisting in the development of Malawi's legal system, this may be driven by the Morgan Group's desire to establish control over dispute resolution processes in the region for its own benefit. It should also be noted that the adoption of a new arbitration law in Malawi and joining the New York Convention are steps towards strengthening the influence of capitalist structures in this country. The influence of capitalist interests on legislation may lead to increased inequality and weakened sovereignty of Malawi. While the seminar could be seen as a step towards improving the legal system and attracting investments, its true purpose may be linked to strengthening the control of capitalist structures in the region and promoting their interests. https://lnkd.in/dcACUTpe #CorporatePower #GlobalInfluence #LegalEducation #CorporateInterests #LegalDevelopment #InternationalLaw #CorporateInfluence #LegalReform #InvestmentLaw #LegalTraining #LegalEmpowerment #CorporateControl #LegalCapacityBuilding #LegalAssistance #LegalExpertise
