This article from today’s New York Times highlights several important things companies should consider in connection with document retention policies. First, don’t destroy anything. That should be obvious. Second, don’t send emails out to Company employees telling them not to send emails about important subjects. Third, don’t think you can hide behind your lawyers and create fake privilege claims because, ultimately, the ruse will be uncovered by the court in the event that the privilege designation is challenged. Attorney client privileged communications are supposed to be for real legal advice not a subterfuge to hide information. Anyone ever worked with or for Glover Priest? We've just been threatened with legal action ... for having a positive review of their firm on our site. 🤷♂️ They seem to believe websites are not allowed to mention their name without their express permission. Surely a large law firm such as them can't possibly really think that? The staff member who threatened us even left a personal negative review about us on Google before making the threat. I assume that review will be removed if we comply? But the whole thing makes me very suspicious. Could this be an ex-employee trying to damage Glover Priest's reputation? I mean, obviously our first instinct is to change the positive review to negative. Or are Glover Priest really this ... (well, pick your own word) ... to go around threatening websites that have positive reviews on them?

Recently, on more than one occasion, I've seen an attorney respond in a hostile manner towards a negative review. It may feel great in the moment to put someone in their place after they’ve attacked you or your firm’s credibility, but the cost far outweighs the benefit. By responding harshly and unprofessionally to negative Google reviews for example, you set the precedent for how potential clients think you will be going forward for them. And it will turn them away. It would definitely turn me away. How to navigate this? When receiving a negative review, take a day before reacting and process it. Craft a professional response and work with the client to see if there’s something that can be done to resolve the issue. Of course, this won’t always work. However, it will help your law firm make the best of a bad situation and prevent it from escalating further.
