What is the Fair Chance Housing Act? How does it impact co-ops, condos, and HOAs starting in 2025? NYC already boasted the most extensive and specific list of protected groups in the nation regarding housing discrimination. With the passage of the Fair Chance Housing Act by the NY State Legislature earlier this year, another group has been included in this list: convicted felons. The law emerged from the racial justice movement and was partly a response to the escalating issue of mass incarceration over the last three decades due to the War on Drugs. It aims to provide individuals caught in this cycle with an opportunity to move forward in life. Under the new law, conducting a criminal background check as part of an application for purchasing condo or co-op shares or renting an apartment is no longer permissible. The Fair Chance Act does have exceptions for sex offenses and individuals with additional misdemeanor or felony charges within three to five years after completing their sentence. It also accounts for federal, state, or local laws safeguarding victims of domestic violence, sex offenses, or stalking, or allowing exclusion based on criminal history. However, the law does not apply to owner-occupied two-family housing or rooms within owner-occupied housing. In the context of co-ops, condos..., this means that boards, managers, and other application reviewers can no longer inquire about a prospective buyer's criminal history and must remove such inquiries from all printed and digital applications. Although the law was passed in January 2024, it will take effect in January 2025 to give owners, managers, and boards time to adjust and adhere to the new regulations. What Should Boards Do? There are numerous valid legal reasons why a board, particularly in a co-op, might choose to reject an application from someone with a criminal history unrelated to their conviction. For instance, if the applicant is a celebrity, the board and community might be concerned about potential security issues that could arise. It's important to note that co-ops generally have more discretion in rejecting applicants compared to condo boards. However, in a condominium scenario, the board could delay issuing the waiver of rights of first refusal, effectively acting as a veto. H.S.C. The Twin Cities region of Minnesota, encompassing counties such as Anoka, Hennepin, and Ramsey, is home to nearly 1.25 million households, making it the largest population center in the state. Of these households, 31% are renters and 69% are homeowners. Housing affordability is a significant issue, with many residents facing a cost burden, as 332,554 households spend more than 30% of their income on housing. The region also has the largest shortage of affordable housing for extremely low-income (ELI) renters, with 64% lacking affordable options, representing a shortfall of 64,890 units. In 2023, the Twin Cities saw 15,636 eviction filings, up from the pre-pandemic average of 11,692. On a single night in 2023, 6,254 people experienced homelessness, with a significant number being Black, Indigenous, or people of color (BIPOC). Racial disparities in homeownership are stark, with 76% of white households owning homes compared to just 47% of BIPOC households. The Twin Cities metro area has the nation’s highest racial gap when it comes to homeownership, largely because investors have been purchasing hundreds of single-family homes and turning them into rentals, therefore eliminating options for potential home buyers in some areas, according to a report by the Urban Institute. The cost of housing is increasingly out of reach, with the salary needed to afford a median-priced home in Scott County at $118,560 and a two-bedroom apartment at $64,880, while many in-demand jobs do not pay enough to meet these housing costs. Housing is a basic need that everyone should have access to. The Green Line and Stories of Ours are looking for Torontonians with a housing story to tell! 🏠 The Green Line’s housing affordability issue exploring Toronto’s housing crisis will culminate in a storytelling event in March 2024 that centres the experiences of people who have personally navigated our city’s housing ecosystem. We’re seeking storytellers who have personal experiences with housing in Toronto, ranging from finding affordable housing to exercising tenant rights to exploring home ownership and beyond. We encourage submissions from diverse people of all backgrounds, race, gender, national origin, age, religion, creed, disability, sexual orientation, gender identity and gender expression. No need to have a fully prepared story to express your interest, just enough to describe what your story will be about.
