Hedge fund Eisler Capital hit with legal challenge by London specialist headhunter London-based investment firm Eisler Capital is facing a £388,800 legal challenge by a specialist hedge fund headhunter over alleged breach of contract. Monroe Partners is a London-based placement agent and senior recruitment specialist for hedge funds. It has called on national law firm Acuity Law to file a claim in the High Court last month against Eisler Capital. According to its claim form as seen by City A.M., Monroe and Eisler entered into a contract in November 2022 for Monroe on a non-exclusive basis, to introduce portfolio managers (or groups of portfolio managers) to the Eisler, in return for recruitment fees. The claim outlines that the recruitment fee for a portfolio manager is a flat fee of $400,000 (£319,200) upon hire and $200,000 (£159,600) upon completion of the first year of employment. https://lnkd.in/g_htNgkF

Hedge Fund Demands $100 Million From Its Compliance Team After SEC Probe Chatham settled SEC investigation into bond-trading practices Anthony Melchiorre’s firm blames consultants for its troubles Wall Street firms usually grumble in private after getting punished by regulators. Anthony Melchiorre’s Chatham Asset Management is dragging its advisers into a public legal battle for $100 million. The $6 billion hedge fund is demanding that Adviser Compliance Associates not only cover Chatham’s costs for settling a US probe last year, but also damage to its business. In an unusual lawsuit, Chatham claims the outside consultant, founded by former regulators, failed to prevent trading practices that ran afoul of authorities. https://lnkd.in/gYb9XazS #recordkeeping #whatsapp #compliance #sec #text #texting #textmessaging #SMS #MMS #imessage #facetime Apple Google Meta Facebook #Android #apple #google #meta #facebook #compliance #financialservices #technology #whatsapparchiving WhatsApp WeChat

Schulte partner Kelly Koscuiszka lent her insights to The Hedge Fund Law Report for their in-depth coverage of “current reports” amendments made to Form PF. In Part II of the series, Kelly tackled the challenges and approaches to reporting and the future of Form PF “current reports.” As hedge fund managers develop best practices, Kelly articulated the nuances involved when determining who the critical decision makers are in the reporting process, dependent upon the organization’s structure, “Some firms are small enough that the GC/CCO will make these decisions because they’re wearing a couple of different hats already or function like they do. At other places, it may depend on the trigger. The more common approach of large managers is to have a working group or some kind of reporting line, so it isn’t up to just one person.” When it comes to “close calls” on when and what to report, Kelly suggested taking a measured stance, noting, “I would say Advisers are taking a thoughtful approach. The adopting release to the Amendments suggested, ‘When in doubt, file.’ That’s not really good for anyone, though, including the SEC. When so many reports are submitted, there’s so much noise that the regulator can’t actually identify the substantive ones. It’s not a good model if this becomes something other than a thoughtful filing.” Read more of Kelly’s commentary: https://bit.ly/3TJ8Bcq #HedgeFunds #SchulteLaw

Lawyers & Hedge Funds: 90% Fallout Mayhem Unfolds! The CLJ filing deadline has come and gone. Attorneys predict over 400,000 claims, but the number of viable cases may be a different story. So far, I'm hearing hedge funds are furious, and attorneys at my last conference commented that only about 10% of their cases are good. 90% fallout rate is unacceptable. Sourcing intakes from vendors that get their leads from affiliates, Coreg, and offshore is risky and costly, and it is a tactic that must die. The solution is custom, branded campaigns with complete transparency on how the marketing budget is allocated—no white-labeling intakes.
