The provisions in the Charities Act 2022 that introduced new rules for updating charity constitutions are *all* in force. In this MBL Seminars Ltd webinar ⬇ I explore the new rules for updating governing documents of Royal Charter and statutory charities which have been in place since 31 October 2022. I also cover new rules, which came into effect in March this year, for updating the constitutions of the four most common types of charity structure: companies limited by guarantee, charitable incorporated organisations, charitable trusts and unincorporated associations. In terms of updating charity constitutions, the Charities Act 2022 has two main aims: to give trustees greater flexibility and to harmonise the processes for amending governing documents for incorporated and unincorporated charities. I look at the extent to which these aims are met and where differences prevail because the aims do not go hand in hand. Building strong foundations. Being registered with the "funding regulators" is a step in the right direction as we aim to align with national pathways in society, so we can better meet their needs and serve the communities we work with. That said, we have a comprehensive set of policies in place, which allows others to collaborate with us more easily. This is very important, especially since we have limited resources. Having partnerships, collaborations, and grant funding enables all organizations to leverage these arrangements. Interesting insights from Gary Beharrell, Lloyds Bank Foundation for England and Wales's east midlands regional manager, about how large charities winning local contracts could cause smaller organisations to close. He says “There are two common outcomes to larger national organisations winning local contracts. One is where the small charity closes, leaving no services when the larger charity inevitably ends the contact. “The other is where the large charity subcontracts to a local charity to deliver the same service at a fraction of the cost they received before or that of the winning contract. Either way, the people who rely on these public services lose out.” What are your views?
