Whilst reading the Law Commission 54 Act paper in full is, to coin a phrase of an old supervisor, "a pleasure I have, so far, denied myself" its encouraging that the Commission is opening up the books to the broadest possible options, all the way from "full compulsory security" to "no security at all". Whilst I shall not place bets on the outcome of the report (though I might be tempted with some cynicism to place bets on whether anything will be done with the eventual recommendations) I wonder whether security per se is actually something that matters to tenants any more. Casting my mind back, I am not aware that I have personally ever come across a situation in my practice where a tenant has said "if I cannot renew my lease, I will go out of business - I have nowhere else to go" (though assuredly there must be examples of this happening). We are told the 54 Act was brought in to aid in postwar reconstruction. For tenants certainty was key. But now it would appear that flexibility is the watchword. Margins are tighter, costs are higher. And we see tenants taking shorter terms with greater flexibility built in. As the rateable value compensation figure available to tenants on quitting a 54 Act tenancy bears less and less reality to the actual costs of moving - might it be that what the market would welcome is an abolition to security in and of itself, but instead focussing on a compensation scheme that looks to more accurately compensate tenants for the actual cost of moving premises (by which I would include the benefits of rent frees etc on new premises and potential savings on dilapidations liabilities in cases of redevelopment). Its getting harder for landlords to get hold of premises, as the mission creep of ground (f) and (g) cases over recent years show. The troubling creaking of the county court system does not help. Our building stock is in need of renewal and tenants are more willing to be flexible. Does the law need to coalesce less around the concept of security - and more around the actual costs of tenants leaving premises? I suppose the responses to the consultation might help tell us.

#ScottHilton #Laytons Having handled lease renewals for over half a century I find this Court decision incredulous. #KwikFit’s claim for 5 yearly break clauses in a new 15 year lease was rejected by the Court, on grounds that the expired 25 year lease didn’t have them Most comparables will have been negotiated without breaks and Kwikfit can’t have them, because they took a 25 year lease way back A real win for Landlords I wonder what the result would have been on a more customary expiry of a 10 year lease without breaks It seems arguable that the Landlord could refuse a tenants break request, whereas Lettings in the building have been offered with them The only compensation to the Tenant is that he could argue for a discounted rent, due to the lack of Tenant flexibility compared with the comparables A flood of Court cases will doubtless follow
