As we assist clients to resolve disputes about some money or property, it is often worthwhile to reflect upon the much bigger struggles which have been overcome in history. Litigation is, on a theoretical analysis, nothing more than a decision-making process, carried out in a cold, objective fashion. In reality, at the coalface, it often is more akin to violence, with each party seeking to destroy the other’s credibility. As mediators, we do what we can to encourage clients away from violence and towards negotiation. Hopefully, Nelson Mandela’s words above can help people to bring their disputes into perspective and assist clients in reaching resolution. Call a truce…let’s talk about it.

When Eric Dodson Greenberg joined Cox Media Group as general counsel in 2021, he tapped the company's legal operations manager, Letitia Haynes-Frasier, to turn a fragmented legal unit into a model of efficiency. One of her early victories was establishing billing guidelines that eliminated loopholes commonly exploited by law firms. Her initial approach was narrow, focusing on compliance. But Greenberg encouraged her to take a broader view. “We didn’t want the guidelines to feel like a list of rules,” he explained. “Instead, they had to foster a partnership with our outside counsel.” This nuanced approach paid off, strengthening relationships with law firms while also creating internal accountability.
