I put up a post yesterday making reference to different colour markings for assets within the AS5488. Writing a post is difficult, its like someone asking for a '5 minute' overview of a subject. You need (or should be) to be carefully in what you say, remembering that sometimes people take as 'gospel' what you are saying but also they want a quick answer. The same goes when writing something, I mentioned colours. I could have (or do at times) have a conversation on that one point. Do you have to use the colours within the AS5488 Standard??? That 1 question again is potentially a minefield, therefore unless I can answer it fully I will not answer on here. Why? It is because I need to: 1. Fully answer 2. Make sure you have understood my reply and had time to ask questions to clarify. The conviction under OHS Code Section 368 in this case demonstrates the application of ergonomics/human factors to critical safety controls.
Conviction: Excel Projects Ltd. was in court yesterday for an incident that occurred in March 2022 as an equipment operator was preparing a CAT D4H pipelayer sideboom for transport. While the operator was on top of the tracks at the entry to the open cab, the pipelayer drive mechanism became engaged. The operator was pulled between the moving track and side boom lower support arm resulting in fatal injuries. Excel pleaded guilty to Section 368 of the OHS Code for failing to ensure that an operational control, a parking brake lever, on equipment, a sideboom pipelayer, was designed, located or protected to prevent unintentional activation, and, appropriately, was suitably identified to indicate the nature or function of the control. The sentence included a $5,000 fine and an order to pay a $345,000 creative sentence under Section 49 of the OHS Act. The creative sentencing funds will be used to establish the Gerry Kennard Safety Award Scholarship at both Olds College and Portage College, and awarded to students enrolled in the Heavy Equipment Operator program who achieve the highest safety-based marks in each cohort.
