As stated by the Government of Canada, "[t]his funding supports Mediate BC’s Navigating Collaborative Decision-Making in Child Welfare project. Through this program, Mediate BC is developing public legal education and information resources and is providing legal support for Indigenous and racialized families navigating the child welfare system. This includes the creation and distribution of plain language resources in multiple languages, community outreach and workshops, and the expansion of legal advice and support services provided by Collaborative Decision-Making Navigators. Calling all attorneys, judges, child welfare & DV Advocates who want to learn about best practices in cases involving domestic violence and children, this #ChildAbusePreventionMonth. Nicholson v. Scoppetta was a seminal New York state court decision that rose to the federal appellate level and established a critical legal framework for evaluating child abuse and neglect allegations in cases arising from exposure to domestic violence. The decision requires child welfare agencies to produce four categories of evidence when seeking judicial authorization to separate a child from the care and custody of a domestic violence survivor: 1) Imminent Harm 2) Parental Care 3) Individual Agency Support 4) Harm of Removal FUTURES has partnered with the National Center to Advance Peace for Children, Youth, and Families, the ABA Center on Children and the Law, and, most importantly, Sharwline Nicholson and other survivors of DV and the child welfare system to create this brief. Concerned and dismayed to learn that the federal cabinet has abolished vital institutions like the National Commission for Child Welfare and Development, the National Child Protection Centre, and the implementation of the National Line of Action. These offices, under the Ministry of Human Rights, play crucial roles in safeguarding our children's rights. The decision to include employees of these departments in the surplus pool is deeply concerning. Children are our future, and their protection should be a top priority. #ChildRights #ProtectOurChildren #HumanRightsViolations
