IS A BAN ON HEMP DERIVED THC PRODUCTS THE ANSWER? The letter sent from the US Cannabis Council to the Senate Agriculture Committee on April 10 requests just this. It includes a ban on products with ANY DETECTABLE THC and is not limited to synthetic or converted cannabinoids. It also does not define intoxicating. This request would crush a booming industry and cast shade on all operators. Yes, that industry does include some operators using synthetically derived or converted substances that may pose health concerns, however, this overreaches to include responsible operators that are manufacturing safe products that have delta-9 THC under the legal limit. There needs to be regulation but it should foster growth not squelch it. The hemp derived beverage market is estimated to have reached a comparable size to the craft beer market--eliminating the entire market without a targeted definition of intoxicating or distinction for synthetic and converted cannabinoids is "throwing the baby out" with the cannabis water in my opinion. The utter failure of regulatory bodies and lobbying organizations to effectively manage state cannabis markets stands as a glaring irony in light of the U.S. Cannabis Council’s push to reschedule intoxicating cannabinoids to a Schedule 1. It's baffling that an industry group would advocate for ineffective prohibitionist policies when regulatory incompetence has always been so blatantly evident. Their misguided stance only adds insult to injury, further highlighting the urgent need for a radical overhaul of regulatory frameworks that truly serve the interests of the industry and its consumers. As marijuana industry groups continue to push monopolistic policies and attempt to stifle the hemp market, the regulated marijuana market will continue to struggle and potentially collapse.

Aflatoxins and Ochratoxin A: These are toxic substances produced by certain molds and fungi that can contaminate cannabis products and pose serious health risks 1 . Total Ash and Residual Solvents: These contaminants can be byproducts of the extraction and conversion processes for cannabinoids and may need to be removed before the product is safe for consumption 1 4 . Unidentified Compounds: Some cannabis products have been found to contain multiple unidentified compounds with unknown toxicological harms, highlighting the potential risks associated with consuming these products 4 . The presence of these contaminants in cannabis-derived products sold in gas stations underscores the importance of thorough testing, quality control, and regulatory oversight to ensure the safety and quality of these products. Let's talk about hemp. In 2018, hemp (defined as cannabis with less than .3% THC) was federally legalized via the Farm Bill. Cultivation for industrial purposes and CBD extraction were the top lines of this regulatory change, but prohibition has a way of incentivizing loopholes, and now, 6 years later, an entire market of intoxicating, hemp derived products has emerged. With little to no guidance from the Feds, states are scrambling to deal with these products, which are available in a wide variety of retail outlets, largely untested, and shipped across the country. Congress is revising legislation related to hemp-derived products as part of the 2024 Farm Bill reauthorization and the Agriculture-FDA Appropriations bill. The House proposes redefining "hemp" to include only naturally occurring, non-intoxicating cannabinoids, excluding those with quantifiable amounts of Total THC. This change aims to address issues resulting from the 2018 Farm Bill, which inadvertently led to a thriving market for hemp-derived cannabinoids, some of which contain THC levels exceeding the intended limit. The Senate version of the funding bill currently lacks hemp-related provisions, but negotiations between the House and Senate may result in a compromise before final passage. The changes could take effect as early as this fall, potentially preceding the DEA's final regulation on marijuana rescheduling.

Florida House Panel Advances Bill To Restrict Hemp Cannabinoids! A Florida #legislative #subcommittee on Monday advanced a bill to restrict psychoactive hemp-derived #cannabinoids such as Delta 8 THC and Delta 10. The legislation, House Bill 1613, was advanced by the House #Agriculture and Natural Resources Appropriations Subcommittee by a vote of 8-4. The 2018 Farm Bill legalized #hemp and hemp products at the #federal level, leading to a surge in new hemp #businesses nationwide. Under the legislation, #cannabis with no more than #0.3% #Delta 9 THC (the compound largely responsible for the “high” experienced when smoking marijuana) on a dry weight basis is considered #legal hemp under federal law. The bill also #redefines hemp to “outline that hemp extract may not exceed 0.3% total delta-9-THC #concentration on a wet-weight basis or exceed 2 milligrams per serving and 10 milligrams per container on a wet-weight basis,” according to a report from Florida Politics. https://lnkd.in/gTPBiB_8

#CannaFraud is big deal. How do you know that d9 distillate you purchase isn't some frankenmolecule converted from CBD extracted from #Cannabis sativa L. plants that can be classified as #Hemp? Worse still, how can you be certain any cannabinoid containing product on the market right now isn't full of manufactured (synthetic) cannabinoids? What if there was a way to tell the difference between phyto-cannabinoids and everything else? What if there was a certification verifying a consumer product claiming to contain phyto-cannabinoids, actually did? Would these things make a difference? If there was a symbol for clearly identifying consumer products containing phyto-cannabinoids that appeared on packages, would this help consumers looking for these type of products find them? Would it help product manufacturers distinguish themselves in a saturated space? Would it help regulators with regulating these type of cannabinoids? My team and I at CSQ Cannabis Safety & Quality think so and have put together an amazing group of scientists to create the specifications and test methods the global industry needs to protect itself from fraud, specifically canna-fraud. This work is being conducted through ASTM International Technical Committee D37 on Cannabis in collaboration with members from E18 on Sensory Evaluation, and will create at a minimum three standards: Specification for an International Symbol for Identifying Consumer Products Containing Phyto-Cannabinoids Specifications for Cannabinoids to be Classified, Marketed, Labeled, and Sold as Phyto-Cannabinoids Specifications for Cannabinoids Produced through Precision Fermentation, Converted from other Substances, or Manufactured to be Legally Sold into Legal Markets Below is a screen shot of a very rough draft for the International Phyto-Cannabinoid Product Symbol (IPCPS).
