Experts Discuss Adjudication and Electricity Act At NERC Seminar In furtherance of providing updates on the Nigerian Electricity Supply Industry (NESI) to the judiciary, the Nigerian Electricity Regulatory Commission (NERC) brought together experts in the power sector and the legal profession to discuss key issues in the industry, the role of adjudication and the Electricity Act on Tuesday. The seminar was organized by NERC in collaboration with the National Judicial Institute (NJI) for Justices of the Supreme Court and Court of Appeal in Ikot Ekpene, Akwa Ibom State, and has the theme: ‘Reforms in the Electricity Sector towards Sustainability'. In a presentation titled: ‘Adjudication towards the growth of the electricity industry in Nigeria’, the facilitator, Prof. Yusuf Ali SAN, said adjudication plays a vital role in the growth of Nigeria’s electricity industry by ensuring contract enforcement, resolving disputes, and maintaining regulatory compliance. “Addressing the challenges within the electricity sector, through effective adjudication, is crucial for realizing these benefits and ensuring the long-term development and prosperity of Nigeria,” he stated. Prof. Ali also advocated that electricity should be viewed as an economic service rather than a social service. In another presentation titled: ‘The Political Economy of Power Sector Reforms in Nigeria’, the facilitator, Ukera Seungwa Emmanuel spoke about the long-term agitation by states for a decentralized electricity market which is a reality with the constitutional amendment and the enactment of the Electricity Act, 2023. To enhance the role of the judiciary in resolving legal issues in the power sector, Mr Ukera said there is a need for the continuous training of judicial officers and members of the legislature. “This will help them to understand the complexities of the reforms and to address observed or perceived knowledge gaps in the industry across the actors in the reform process,” said the facilitator. Aigbe Olotu spoke on ‘An Investor’s perspective of the Investment Opportunities/Challenges in the Nigerian Power Sector’, stating that whilst several challenges have hindered the optimum performance of NESI, there are also opportunities available to investors to turn the sector around.” Mr Olotu said the judiciary has a role to play in fostering investment, stability, and growth by providing legal certainty, protecting investments, and backing regulatory oversights. The NERC DGM Market Competitions and Rate Division, Abba Terab, in a presentation on ‘Electricity Tariffs in Nigeria’ took the participants through the process of setting tariffs for electricity. NERC Promotes Judicial Awareness on Electricity Industry Operations The Nigerian Electricity Regulatory Commission (NERC) is promoting the awareness of the judiciary on the operations of the Nigerian Electricity Supply Industry (NESI). Given this, NERC in collaboration with the National Judicial Institute (NJI) has organized a seminar for Justices of the Supreme Court and Court of Appeal in Ikot Ekpene, Akwa Ibom State with the theme: ‘Reforms in the Electricity Sector towards Sustainability'. In his address, the Administrator of NJI, Hon. Justice Salisu Garba Abdullahi, noted the sustained collaboration between NERC and the NJI especially in providing guidance towards steering a pathway to sustainable reforms in the electricity sector. In his opening address, the Chairman of NERC, Sanusi Garba, represented by NERC Commissioner, Finance and Management Service, Nathan Shatti, said it is the desire of NERC to continue to find ways to organize such engagements to deepen collaborations with the judiciary. He said: “One of the key objectives of the seminar is to stimulate a discourse on emerging legal issues relating to the Nigerian Electricity Supply Industry, and to apprise the judiciary of the recent changes in the regulatory landscape.” The NERC Commissioner also told the Justices that NERC has transferred regulatory authority to seven states and that the Commission was prepared to continue to do more. The Chief Justice of Nigeria (CJN), Justice Kudirat Kekere-Ekun represented by Hon. Justice Adamu Jauro while declaring the seminar opened, acknowledged the role of electricity as a critical driver of viable economic growth prompting the need to sustain key reforms to improve electricity. Towards this, the CJN noted the imperative for judicial officers to understand the sector. The NERC Commissioner, Legal, Licencing and Compliance, Dafe Akpeneye delivered a presentation titled, ‘Legal Framework for the Electricity Industry in Nigeria and Emerging Changes’ in which he explained the implications of the Electricity Act 2023 as a critical move to sustain the power sector reforms. Also making a presentation on ‘Brief Overview of the Nigerian Electricity Supply Industry (NESI)’, NERC Commissioner, Consumer Affairs, Aisha Mahmud highlighted challenges in the NESI that impede its development. Commissioner Mahmud however noted the gains of a strong collaboration with the judiciary. “Experience has shown that resolution of the NESI challenges can be made or marred by the Judiciary. We’re Committed To Protecting Consumers’ Rights, Quality Service – NERC The Nigerian Electricity Regulatory Commission (NERC) has reiterated its commitment to protecting the rights of electricity consumers rights while ensuring that Distribution Companies provide quality service. The NERC Commissioner, Consumer Affairs, Aisha Mahmud stated this at a town hall meeting in Osogbo in Osun state, in collaboration with Ibadan Electricity Distribution Company (IBEDC). The gathering was to have an audience with IBEDC customers and address their complaints. Mrs Mahmud, set the tone with her opening remarks. "NERC is committed to protecting consumer rights and ensuring quality service delivery," she emphasized. "Customers have the right to efficient and reliable electricity supply, and we've implemented initiatives like customer enumeration and prepaid meter deployment to achieve this." The NERC head of consumer affairs stressed the importance of collaboration, noting that customers, IBEDC, and NERC must work together to overcome challenges. Also speaking, the representative of IBEDC’s acting managing director and Coordinating Head, Corporate Services, Angela Olarewaju reinforced the commitment of NERC on customer satisfaction. She said: "We recognize our customers' challenges and are dedicated to addressing them. Our customer enumeration exercise ensures accurate billing and improved service delivery. We urge customers to cooperate with our officials." In his presentation, Mr. Johnathan Alanji of NERC explained the rights and obligations of electricity consumers. He stressed that consumers have the right to a reliable electricity supply. Customers also have the right to be billed based on their actual consumption, among others. NERC Urges Osun Residents For A Parley, Complaints Resolution In Osogbo The Nigerian Electricity Regulatory Commission (NERC) has held a road show ahead of a town hall meeting and a three-day on-the-spot customer complaints resolution forum in Osogbo, the Osun State capital. The roadshow which took place on Wednesday was in collaboration with the National Orientation Agency (NOA) and the Ibadan Electricity Distribution Company (IBEDC). While the town hall meeting is on Thursday 10th October, the customer complaint resolution session starts on Thursday and continues until Saturday 12th October. NERC invites electricity consumers and customers of IBEDC in Osun State and its environs to the event as they would have the opportunity to express complaints about electricity supply services and have them addressed immediately by a dedicated customer service team of IBEDC. Officials of NERC, NOA and IBEDC during the roadshow went through major locations in Osogbo town, including the Alekuwodo area, MDS market, Oluode market, Ayetoro and Igbona market. The NOA team used both English and Yoruba to enlighten the residents about the importance of having them attend the town hall meeting. Shortly after the roadshow, officials of NERC and IBEDC took the enlightenment campaign to the media as they appeared on a programme of the Osun State Broadcasting Station for a live chat. Listeners contributed and got responses to their enquiries during the phone-in programme. The NERC team also marked the ongoing Customer Service Week at the NERC Osogbo Forum Office. This office enables IBEDC customers to appeal complaints handled by the DisCo to NERC if they are not satisfied with the resolutions or if their complaints were not addressed. #NERC #Electricity #OsogboTownHall #CustomerService

Electricity Tariff Review: Court Strikes Out MAN’s Case Against AEDC, Others A Federal High Court sitting in Lagos has struck out a case by the Manufacturers Association of Nigeria (MAN) challenging the implementation of electricity tariff review by the Abuja Electricity Distribution Company PLC and 11 others. In the judgment on 7 October 2024, the Court considered all the parties’ arguments and ruled that MAN’s suit was an abuse of court process being premature and without due regard to the provisions of section 51 of the Electricity Act 2023. The Court also held that MAN’s case disclosed no reasonable cause of action as it had not exhausted the dispute resolution mechanism. It thus, held that the suit was not instituted with due process of law, and consequently struck out the case. MAN had challenged the minor review of the electricity tariff by the Nigerian Electricity Regulatory Commission (NERC) and filed a lawsuit at the Lagos Judicial Division of the Federal High Court. MAN sought four reliefs: that due process stated in the Act for the review was not fulfilled before AEDC and the others applied to NERC for the tariff review on 31 July 2023. It stated that regulatory requirements for tariff reviews were not followed before NERC issued the Supplementary Order of 3 April 2024 and the subsequently reviewed rate of 6 May 2024. MAN also held that placing the burden of the tariff increase on only Band "A" feeders and leaving out other bands amounted to discrimination against such consumers. It then noted that the defendants must comply with administrative procedures for tariff review before rightfully implementing the April and May Supplementary Orders. NERC had objected to the suit stating that MAN’s case constitutes an abuse of court processes, being hasty and prematurely filed without following due process of the law. #NERC #Electricity #Tariff #AEDC #Court
