Six things here. 1. this was such an important issue that the letter should not have been sent without full council discussion. it was signed by the CEO and the chair who has currently stepped down from chair due to admitting his farm was technically non-compliant with its consent conditions, a clear conflict of interest. 2. the RMA was touted by national when it passed it as setting environmental bottom lines. this was one of the more significant of those. it is not appropriate to rush through legislation that fundamentally destroys the base of the Act. 3. the matter is still before the cours. by seeking a law change ECan is essentially admitting its grounds for appeal are weak. should it continue the appeal and waste ratepayers money.? Alternatively, if it's case is strong, it should not have wasted the Ministers and other folks time writing to him. 4. the problem for ecan is that it has approached water management aiming for a soft landing for farmers, by setting in place processes to reduce impacts over time. this iscsensible. however it depends on a number of risky assumptions, including quality of the modeling and ability to enforce compliance. it might be the right approach, but it is high risk and apparently contrary to the law. 5. this is the council that has not updated its 2005 regional coastal plan to implement the NZCPS, which is clearly in breach of the law. how much lawlessness should central government tolerate? 6. environment canterbury needs to consider a name change. footnote correction needed to article. it was the regional coastal environment plan not the land and water plan the council ignored.

Excellent new documentary from TVW on the police pursuit issue. Covers both sides. The debate over the last four years has been about how much judgment to give law enforcement. It’s not about “always pursue” vs “never pursue”. It’s about when and how to do it. Currently our highly trained officers and their supervisors are not given enough latitude to decide when and how to pursue. They are prohibited by state law from pursuing in all but a few categories of violent crimes, regardless of the circumstances. It’s resulting in unacceptable levels of crime. I-2113 would maintain high standards for the decision to pursue, but also give the police more discretion than they currently have.
