Are political fundraising solicitations ever reportable as so-called express advocacy independent expenditures? This question has tied the FEC up in knots for decades, and the latest advisory opinion request from American Target Advertising puts the issue before the agency again. The comments on the FEC's draft opinion from ATA (https://lnkd.in/eiNRFaQQ) and myself (https://lnkd.in/eS3JPyTG) illustrate the convoluted logic that can result when solicitations are mischaracterized as independent expenditures.

🗣️First São Paulo mayoral debate is all bark, no bite After the deadline for political parties to select their mayoral candidates passed, the leading contenders — those representing the largest parties or showing significant voter support — for the municipal election in São Paulo faced off in their first televised debate last week. However, rather than any substantive discussion of policy, the event devolved into a barrage of accusations, insults, and little in the way of detailed responses to questions from opponents and journalists. Key topics such as revitalizing São Paulo city center, addressing long wait times in the public health system, job creation, the role of the metropolitan civil guard, traffic safety, and mobility received scant attention.
