A leaked draft decision from The Supreme Court appears to show voting in favor of maintaining EMTALA, the critical right to emergency medical care including abortion. We were prepared for a loss in this case given the court’s previous history, and while this is a welcome surprise, we’re not willing to celebrate the bare minimum. The right to LIFE SAVING abortion care in the event of a medical emergency shouldn’t be a contentious topic. Our human right to live should not be up for debate. Despite this potential respite, we must remain vigilant. We doubt this is the last we’ll hear of abortion access on the national stage or at the state level. Abortion rights remain at risk and under attack by a slew of draconian and controlling legislation. The US Supreme Court 🏛️ is revisiting abortion policy in a pivotal case on March 26th. At the heart of it is the accessibility of the common abortion pill, mifepristone 💊. FDA v. Alliance for Hippocratic Medicine delves into FDA actions in 2016 that made mifepristone easier to obtain, now contested by medical groups against abortion rights. The fate of mifepristone hangs in the balance, affecting abortion access across the nation 🇺🇸. FDA changes in 2016 and 2021, such as allowing mail distribution 📬 during the pandemic, broadened accessibility. A Supreme Court reversal of FDA policies could restrict or even abolish mifepristone access. ⚠️ SCOTUS has agreed to hear a case that could make it far more difficult for people nationwide to access mifepristone, a medication used in most abortions. ⚠️ This ruling could limit medication abortion in New Jersey. This is troubling and means that it’s more urgent than ever for NJ lawmakers to pass the Reproductive Equity Act. The REA is a critical piece of legislation that will dismantle barriers for those seeking abortion care and make abortion equitable and accessible for ALL in New Jersey. NJ lawmakers have not advanced this bill in the last year and a half. The longer the REA stalls, more and more New Jerseyans are unable to access abortion care. Americans are divided on whether women should have to see a doctor in person before receiving abortion pills, a new Reuters/Ipsos poll found, as the U.S. Supreme Court weighs whether to reimpose that restriction on medication abortion. But broad bipartisan majorities opposed the idea of allowing states with abortion bans in place to block access to the procedure in certain emergency cases when it is needed to protect the mother's health, at issue in another case before the court. The findings come as the court is preparing to rule on its highest-profile abortion cases since 2022, when the justices overturned the landmark 1973 Roe v. Wade decision that established the national right to abortion. Some 50% of respondents in the May 7-14 survey said they supported an in-person doctor visit requirement for abortion medication, while 33% said they opposed that rule. 17% said they were unsure. What is happening in Arizona with this state Supreme Court decision affirming a 160-year-old draconian near-total ban on abortion is outrageous. This law was passed before Arizona was even a state and before women had the right to vote. This will only lead to more individuals traveling to states like California for abortion and other reproductive healthcare. Here in California, we have enshrined the right to reproductive freedom in our state constitution, and we have prepared for this influx of abortion need arising from states that criminalize patients and doctors.
