The Law Council welcomes today’s tabling of the Senate Legal and Constitutional Affairs Legislation Committee’s report into legislation establishing the new Administrative Review Tribunal (ART). We are particularly pleased by the level at which the Committee has engaged with the Law Council’s written submissions and subsequent evidence provided at a public hearing on 3 May 2024. The Committee’s recommendation that the operation of migration and asylum matters within the ART should be referred to the reestablished the Administrative Review Council is an important step. We are also supportive of a number of considered recommendations within the dissenting report prepared by the Deputy Chair of the Committee, including that: - there should be a discretion for the ART to award costs to the applicant in exceptional circumstances; - there should be greater procedural fairness afforded representatives prior to an order being made to remove them from proceedings; and - a referral should be made to the Independent Security Legislation Monitor to ensure that intelligence and security matters in the ART are striking an appropriate balance is struck between national security, fairness and transparency. We will continue to closely monitor the passage of this landmark reform as it is debated in the Senate in the coming weeks. https://lnkd.in/g_q548NH #auslaw
