Link below to the Grenfell Report. Conclusions p171, Testing & Materials p179, and Recommendations p229. It makes for some grim reading, which should not surprise anyone working in the industry. I have not read the whole thing, but this bit in section 113.33 jumped out: 'We therefore recommend that a licensing scheme operated by the construction regulator be introduced for principal contractors wishing to undertake the construction or refurbishment of higher-risk buildings and that it be a legal requirement that any application for building control approval for the construction or refurbishment of a higher-risk building (Gateway 2) be supported by a personal undertaking from a director or senior manager of the principal contractor to take all reasonable care to ensure that on completion and handover the building is as safe as is required by the Building Regulations.' https://lnkd.in/dB_9Ewu7

Juliana Jorissen, Katherine Vines, Su-En Hia and I recently published an article in the ACLB on the recent expansion of the Unfair Contracting Terms regime under the ACL and how this might impact contracts commonly entered into in the building and construction industry, including tips to avoid contravening the regime. A worthwhile read for anyone dealing with standard form contracts!

🏗️ The recent Technology and Construction Court decision in BDW Trading Limited v Ardmore Construction Limited [2024] EWHC 3235 confirms the broad scope of adjudication clauses, allowing historical defects claims under the Defective Premises Act 1972 (DPA), with extended limitation periods introduced by the Building Safety Act 2022. This case highlights the importance of maintaining proper record-keeping for historic projects, as natural justice arguments around documentation imbalances and the passage of time may fail. We discuss the practical implications of this decision for contractors, including the importance of early engagement when a claim is made 🔗 https://bit.ly/40xdPeL
