Phillip Lonergan recently spoke at Tahota Law Firm's seminar based in Xi’an, China. Mr Lonergan gave a presentation on the different approach to Commercial Litigation in Australia and China. The 1997 UNCITRAL Model Law on cross-border insolvency has influenced legislation in more than 60 jurisdictions. Through enactment and judicial interpretation, the effects of the model law have diverged along national borders. One example of this is the public policy exception in Article 6, which was intended to be a high bar. In certain states (including Great Britain), recognition and relief may be denied if it would be 'manifestly' contrary to the adopting state's public policy. Certain other jurisdictions (including Singapore) have chosen simply to refer to the action being contrary to its public policy. In practice, does this distinction matter?
