It's so important to have full and meaningful consultation to ensure that any changes improve rather than undermine employment practices. Ultimately, it has always been the case that if you recruit well, onboard well, induct well, train well, and proactively assess performance & cultural fit, you should have little to worry about. However, sometimes that still isn't enough and things go wrong. Day 1 rights would undoubtedly see some employers move to short-term contracts or the use of temps, and more hastily dismiss in the early days due to performance concerns. However, the reality is that we probably all need to improve our recruitment processes, our management of performance, and our management of conflict. If we do these things then we shouldn't even have to think about the 'magic' two year mark, or worry about it being reduced.
On Tuesday 1 October, Peter Cheese joined a roundtable discussion with the Deputy Prime Minster Angela Rayner and the Business Secretary Jonathan Reynolds to discuss Government plans to scrap the unfair dismissal qualifying period under their plans for 'Day 1 employment rights'. Listen to Peter summarise the meeting in this video and our views on the Government's plan. Hot off the press! The CIPD is gathering those of us who attended the Senior Leaders Roundtable last month on 24th October to continue the consultation on this important subject. But what do you think? Should the government simply put a statutory 6-month Probation Period in place for all? #Consultation #EmploymentLaw #DemocracyInAction #WhatDoYouThink

I agree, the call to end at-will employment is gaining momentum, and rightfully so. At-will employment enables employers to terminate workers without reason, disproportionately harming marginalized groups and undermining civil rights protections. The Secure Jobs Act offers a much-needed reform by ensuring workers receive advance notice, written explanations for terminations, and the right to appeal unjust firings. This legislation promotes fairness and accountability, creating a safer and more equitable workplace for all. It’s time to adopt a balanced approach to employment that values both employee rights and employer transparency. #WorkersRights #CivilRights #SecureJobsAct
