Yesterday, I had a discussion with a customer as their legal team had concerns over cargo liability. Freight brokers do not take physical possession of the shipment and therefore do not assume liability in the event of loss or damage. Liability lies with the carrier who is hauling the freight. LTL Carrier liability basically boils down to dollars per pound and FTL Carriers are required to maintain a minimum of $100,000. Cargo claims can be complicated. Nadia Martin, CCP thanks for sharing the details about two temperarture control claims that were denied. I’ve had a few temperature control claims denied as well. And like you, I understood why. However, I also had a claim denied (2 pallets of electronics) due to an "alleged" “dishonest act” by the motor carrier a domestic over the road freight forwarder hired. ✅ Background: The service providers who handled the two-pallet shipment from origin to destination were: Local Drayage Carrier, Over the Road Domestic Freight Forwarder, Over the Road Truckload Carrier, and a Regional LTL Carrier. The two pallets were part of a load consolidation at the over the road domestic freight forwarders dock, that consisted of twenty shipments (multiple drops, multiple shippers and consignees). ✅ Long Story: It’s complicated ✅ Short Story: The shipment of electronics never delivered to the consignee. None of the parties involved accepted liability. As a result, the shipper filed suit against everyone that touched the freight. The domestic over the road freight forwarded filed a claim with their insurer. Two days later, their insurer responded denying the claim and a duty to defend, due to "alleged" "dishonest acts" by the motor carrier. However, they failed to identify who the motor carrier was or the dishonest act. In turn, the domestic over the road freight forwarder retained counsel to peruse their claim against their insurer. Two months later, their insurer agreed to conduct a detailed investigation. However too much time had passed, and it was clear that the insurer had acted in bad faith. Once presented with the actions of the examiner, the insurer agreed to cover the defense cost. Shippers Interest is a transactional policy that provides coverage shipment by shipment, offering quick, reliable protection. However, there's another option to consider—Broad-Form Contingent Cargo. This annual policy may be more cost-effective but requires a proactive approach. Brokers must first attempt to collect from the motor carrier before filing a claim. To provide accurate trucking quotes, you typically need the following information: Origin and Destination: The starting point and final destination of the shipment. Include addresses or at least cities/states. Shipment Details: The type of goods being shipped, including size, weight, and any special handling requirements. Timeline: The desired pickup and delivery dates and any specific time constraints. Mode of Transport: Specify if it's a full truckload (FTL) or less than truckload (LTL) shipment, and if any specialized equipment is required (e.g., refrigerated truck). Additional Services: Any additional services required, such as liftgate service, inside delivery, or hazardous material handling. Insurance Requirements: Specify any insurance requirements for the shipment.
