The EU Commission’s decision to make Tik Tok’s commitment to withdrawing its ‘Tik Tok Lite Rewards Programme’ binding in order to comply with the Digital Services Act (DSA) sends out a clear message that it will take necessary steps to ensure service providers are complying with the DSA. In April 2024, Tik Tok launched a new separate version of the app ‘Tik Tok Lite’ in Spain and France in which it encouraged users to earn points from completing tasks within the app such as liking content, watching videos and following other users. The commitment follows formal proceedings taken against Tik Tok by the Commission in which it expressed its concerns that Tik Tok had failed to carry out proper risk assessments and mitigate the risks associated with the rewards programme (particularly the potential addictive and negative effects it may have on users) as required by the DSA for Very Large Online Platforms. Although the DSA requires stronger commitments from Very Large Online Platforms, this decision reinforces that it is best practice for organisations to be transparent and accountable and importantly be able to demonstrate that it has documented and mitigated the risks.
