Can famous golfer #JackNicklaus reclaim the #nameandimage he sold for #estateplanning purposes? Or did he unwittingly sell his persona? Due to technological advances in exploiting #nameimageandlikeness (NIL), here’s the unprecedented question: If a celebrity cashes in on their image, who owns their persona? Nicklaus sold his name, image, and likeness to Nicklaus companies for $145 million in 2007. The transaction was reported in court documents to be part of a broader #estateplan to cash in on his name, gift $20 million to each of his 5 children, and some to charity. Here is the twist, which could impact celebrities broadly: The Nicklaus Companies have authorized an A.I. version of Nicklaus that can be used to advertise other products. Can they use a name like a brand or is a person’s identity sacred? In a pending NY legal proceeding, the Nicklaus Companies are reportedly fighting for summary judgment regarding ownership of the golfer’s #publicityrights. Nicklaus’s team is asserting that publicity rights remain inviolable without an explicit, written transfer. Oral arguments are scheduled before Thanksgiving. The decision may have far-reaching consequences in planning for and valuing #NIL during a celebrity’s lifetime, in the event of #divorce and after death. There's been a lot of talk recently around the debacle that has been the launch of the Co-op Live arena and all the negative implications surrounding it. But what about the damage this is doing to the Co-op's brand reputation? This week the Co-op has stated they're not the venue owners in an attempt to distance themselves however, it is their name above the door! With a sponsorship deal worth an eye-watering £100m will the impact on their reputation cost more? Is there a way of putting a positive spin on this? Could the Co-op utilise their community and support values to counteract and lessen the impact? Just a small thought 23 🤔 Life of a lottery ticket seller is a typical analogue of us humans. Lottery ticket seller has many lottery tickets with him. Out of this, one of the ticket is a lucky ticket and lottery seller is unable to find out this. He sells that lucky ticket to one of his customer with some marginal price advantage on that ticket. Here is the learning from our lottery ticket seller example 💭🤔 All lottery tickets are opportunities in life to win. But there is hardly one ticket or life time opportunity to get super success in life. Finding that one lottery ticket is the toughest task. If we are not able to find that lucky ticket at the right time, we are giving up that opportunity to someone else. PS: Lottery ticket seller sells ticket everday. He has the opportunity to grab lucky ticket. So, don't worry even if you miss the lucky ticket to someone else. Opportunities with more offers are waiting for another day. 🔵 Manchester City have taken legal action against the English Premier League (EPL) over party transaction (APT) rules, which will begin on June 10. The CFG owned club is seeking to challenge the rules that limit how much can be paid to clubs by companies that are linked to ownership groups. Man City's legal claim says the rules are contrary to UK business law. 💸 According to Sky Sports, Premier League clubs are concerned that if payments aren't restricted, there would be no limit to how much a rich owner could invest in their club. That, in turn, would mean there would be no limit to how much they could spend on players. 💰 Furthermore, Man City are also claiming significant compensation for what they feel has been a set of rules that has damaged their revenues and restricted their business dealings in the past. ⚖️ With this “attack” Man City have now turned the tables on the EPL, as the club are already due to defend themselves against 115 charges of breaching the Premier League’s profit and sustainability rules (PSR). If found guilty, clubs could reportedly seek compensation directly from the champions, which could cost Man City over £1 billion. #manchestercity #epl #premierleague #football

Hi, it’s Deborah and Euzi Would you like to find out what happened when a person played an Instant Win Game (a game of chance whose outcome is predetermined by at the point of purchase) in which at the end of the game, due to a software error, two sets of matched numbers were displayed, one with a £10 prize and one with a £1m prize? The predetermined outcome of the game was a win of £10, but the player claimed a prize of £1m and sought summary judgement on the claim, arguing that terms on which the player relied were not incorporated into the contract and/or were unfair under the Unfair Terms in Consumer Contracts Regulations 1999.
