As a Real Estate Broker, we need to do better to protect all families against bias and discrimination. Decent affordable housing is vital to communities and to our future. Affordable housing can't be financed. Most agents don't want to work in it with families who purchase affordable housing. Is it an appraisal issue or a financing issue or an industry issue? We need to reset standards for financing, purchasing and develop a more attainable program than the 203k to remove barriers to home ownership while providing education and resources for home maintenance and self sufficiency. 🖤

City Zoning Powers Versus Claims of “Disability” Under a Federal Statute: A Sobering Issue? The US Supreme Court will consider claims of municipal authority clashing with those of the sober living business in City of Costa Mesa, California v. SoCal Recovery, LLC, et. al. No 23-71, a pending petition for certiorari to the High Court. The US Court of Appeals for the Ninth Circuit set a new and low threshold for considering suits brought not by individual disabled persons but rather by sober living homes seeking to sue on a “collective basis.” Although focused on two sober living facilities in the City of Costa Mesa, the Ninth Circuit’s decision has wide potential impact on other municipalities throughout the Western United States. That decision is the subject of a petition seeking Supreme Court review. Ring Bender LLP attorneys Norman Dupont, Patrick (Kit) Bobko and Jay Tufano filed an amicus brief on behalf of seven southern California cities and the Association of California Cities-Orange County. The amici argued that traditional municipal regulation of zoning and designation of residential-zoned areas merit judicial deference, particularly in light of the evidentiary failures of the sober living homes to identify even one individual at their facilities who qualified as disabled under the federal statute, the American Disabilities Act. This Act made discrimination in housing transactions unlawful.   The effects of housing discrimination are disproportionately experienced by historically marginalized groups, in particular racial and ethnic minorities, refugees and internally displaced persons, women, indigenous people, LGBTQI+ persons, persons with disabilities, persons living in homelessness and people with low income, pointing to the systemic nature of contemporary housing discrimination. Fair housing practices aim to eliminate housing discrimination and create diverse and inclusive communities. It emphasizes tenant needs over landlord and developer interests, contrasting Gov. DeSantis' approach. Key elements include strengthening tenant protections, outlawing predatory landlord practices, reducing initial rental costs, reforming eviction laws for fairness, promoting housing affordability, and offering special provisions for victims of domestic and sexual violence.
