From the @nationalfairhousingalliance The number of fair housing complaints filed nationwide peaked to record numbers for the third year in a row in 2023. This according to the latest Fair Housing Trends Report released annually by the National Fair Housing Alliance. There were 34,150 fair housing complaints in 2023, compared to 33,006 complaints in 2022. Complaints of harassment increased by 66 percent - the highest since NFHA began reporting harassment-specific data in 2006. Harassment based on color increased by 470.59 percent. The numbers continue an upward trend that highlights the need for adequate funding for local agencies working to address housing discrimination. Just this week, House lawmakers put forth a spending bill that funds the Department of Housing and Urban Development at far less than what local organizations need to adequately serve victims of housing discrimination. In 2016, HUD released its guidance on hostile environment and quid pro quo discrimination applicable to housing. Hostile environment and quid pro quo discrimination had long been evolving through US Supreme Court cases for decades in the employment context and there had been some cases extending the doctrines to housing. Summarizing the guidance, if someone in a community association is subjected to unequal terms and conditions of housing based on their status as a member of a protected class, and the discriminatory conduct is something that the association can stop or may have a duty to stop, then the association’s failure to stop the conduct is, by itself, a fair housing violation. When this guidance was rolled out, I remember hearing complaints that this made associations the “behavior police” and went too far in regulating individual conduct. Associations regulate individual conduct all the time. Take a noise restriction. If the noise is sufficiently disruptive to others, it may be a violation of the documents. We don’t need to know what the person is thinking to tell them to turn down their stereo. Similarly, if someone is screaming racial epithets at someone else, if doing so violates the documents, then it is still a covenant violation, albeit with the weight of a fair housing complaint hanging over the situation. This is what owners should expect of their association. We can’t change hearts and minds but we can enforce the community agreements so that people who want to live in peace can live in peace.
