STANDARD OF WORKMANSHIP IN COMMON LAW In common law, there's an inherent obligation to demonstrate a reasonable level of care and expertise in all professional service agreements. What's considered reasonable care and skill is determined by the standard set by a competent professional in that particular field within the community. Under the civil liability legislation in Australia, A professional is considered to have acted reasonably if it can be proven that they followed a practice that was widely recognized and accepted by a significant number of respected experts in Australia within their field at the time they provided their services. However, if the court finds that a professional's opinion, based on input from their peers, is not sensible or rational, it cannot be used as a reliable basis. For instance, when dealing with matters like aluminum composite cladding panels, the court may disregard such opinions if they are deemed unreasonable. So, construction consultants like architects and engineers are obligated by common law to perform their design work with a reasonable amount of professional skill and care. This duty is demonstrated by the case of George Hawkins v Chrysler (UK) Ltd (1986) 38 BLR 36. In this case, someone got injured after slipping and falling in the showers at a foundry. The showers had tiles that were very slippery. A firm of engineers was responsible for designing and specifying the shower room. These engineers did their homework before making the design. They checked project sheets, brochures, and talked to flooring experts to make sure everything was safe. The court found that the engineers didn't do anything wrong in their work. A GC low bid mentality incentivizes the subcontractor who will spend the least amount of time on the project. Be careful of the systems you create and ensure that the goals of those systems are serving the best interest of your business. Less expensive and tighter schedule IS possible, but it is only accomplished by adding value in the preconstruction phase. Build it well on paper FIRST! P.S. Thowback Thursday to before I decided I could fly from ladders with dire consequences: your daily reminder to use a lift, NOT a ladder when doing crazy things like installing ceiling fans on 20’ angled ceilings.

Timely, accurate and unbiased information is the way to avoid many problems in construction. Floor covering specific, pre-installation site meetings are an important and underutilized aspect of a build/renovation in both residential and commercial construction. Site conditions such as temperature, Relative Humidity, sub-floor moisture and sub-floor flatness requirements, product installation guidelines and who is responsible for what work results are just a few of the items on the agenda. A recent pre-installation site meeting revealed that no provision had been made in the specifications to bring the newly poured concrete flatness from FF/FL values (equivalent to 3/8” within 10’) to what the floor covering installer required - which was 3/16” within 10’ (wall to wall). Not an easy conversation to have in terms of responsibilities, but better to have the conversation prior to the slabs being poured and to take the floor covering installer out of the equation. With timely, accurate and unbiased information, the entire construction team can understand specific product and installation needs in advance and can plan solutions together ensuring warranties are left in place and no delays incurred. BS EN 12825 & CISCA 🕸 In August 2001 a European Standard was issued after several years of consultation between all the European manufacturers and was adopted as a British Standard in November 2001, BS EN 12825 . This specification classifies raised flooring products by their structural performance. Installation issues are clarified by the Access Flooring Association Code of Practice and further clarification will occur when the National Building Specification K41 adopts this standard.
