Contractual disputes - what to look out for. There are often early indicators that relationships are souring - red flags that are warning signs. For example these may include:- - a breakdown in communication - for example a party not responding to emails, telephone calls, missing deadlines etc - Where a party becomes unnecessarily formal e.g. quoting contractual clauses, especially if it’s not something they have done throughout the relationship. - Late payment or late delivery - this is usually a classic sign particularly if it’s happening frequently. - A number of changes at a senior board or management level can be a sign that things are not going well within the organisation and could have a knock on impact on the performance of a contact. #sme #smallbusiness #legal

In the past often when clients come to me with a dispute, usually they start by telling me when they began to realise there was a potential problem, the warning signs that flagged to them that something wasn’t quite right and then things started to escalate. Others come to me because they’re not sure whether there is a problem but having started to witness changes in the relationship, similar to those raised by 43Legal in this post, if there is a problem they want to nip it in the bud and deal with it sooner rather than later. In my experience, the quicker a client acts when the sparks of a dispute arise, the better. Running something by a solicitor and devising how you’re going to deal with a situation sooner rather than later can prevent a full blown dispute arising. It may preserve the relationship or even result in the parties parting ways on favourable terms. Nipping something in the bud can sometimes save a lot of time, cost and energy.
