Next in our continuing series on recently closed claims, a client sustained work-related injuries during a collision with a State-operated truck. Despite a couple years of litigation, the court’s determination of damages occurred after the client’s death. The court did not consider future damages in light of the facts. The estate alleged that the Insured should have insisted on a prior, larger settlement offer that was made prior to the client’s passing rather than the smaller award from the court.
