𝗔𝗜 𝘀𝘆𝘀𝘁𝗲𝗺𝘀 𝗮𝗻𝗱 𝗟𝗟𝗠: 𝗽𝗿𝗶𝘃𝗮𝗰𝘆 𝗱𝗲𝘃𝗲𝗹𝗼𝗽𝗺𝗲𝗻𝘁𝘀 Dutch privacy watchdog Autoriteit Persoonsgegevens has issued a warning about companies' use of AI-powered chatbots after several leaks of private information, including medical details. Workers using digital assistants such as ChatGPT to answer customer questions or summarise large files may save time, but they also pose a risk to privacy, the AP said. In one case, a primary care physician's assistant entered private information about patients into a ChatGPT-based program that was then stored on the tech company's servers and possibly used to train the software," the AP said. Another incident involved a data leak at a telecoms company where an employee fed a database of addresses into a chatbot. It's important that organisations have clear agreements with their employees about the use of AI chatbots. Are employees allowed to use chatbots, or preferably not? If organisations allow this, they need to make it clear to employees what data they can and cannot enter. Organisations could also agree with the provider of a chatbot that they will not store the data entered. If things still go wrong and an employee has leaked personal data by using a chatbot contrary to what was agreed? In many cases, it is mandatory to notify the data protection authority and, where necessary, the data subjects. Recently, the Hamburg Commissioner for Data Protection and Freedom of Information published a discussion paper in which he derived some basic theses, which are already the subject of controversial debate: 1. "The mere storage of an LLM does not constitute processing within the meaning of Art. 4 No. 2 GDPR. This is because no personal data are stored in LLMs". 2. "As no personal data is stored in the LLM, the rights of data subjects under the GDPR cannot relate to the model itself." However, data controllers should be aware that the Hamburg Commissioner clearly emphasises that an LLM is not an AI system and makes a clear distinction here. The processing of personal data in AI systems is confirmed. Meanwhile, the European Commission does not plan to re-open the General Data Protection Regulation (GDPR) before the next report, which is due in 2028. Instead, it will focus on enforcement, as privacy in the age of artificial intelligence (AI) is becoming increasingly controversial.  

📢 The Office of the Privacy Commissioner for Personal Data (PCPD) recently conducted a comprehensive compliance review of 28 organizations in Hong Kong, focusing on the impact of artificial intelligence (AI) on personal data privacy. The review spanned across various industries, and the findings were truly insightful: ✅ Out of these organizations, 21 have successfully embraced AI in their day-to-day operations, utilizing it for data analysis, evaluating job applicants, and even enhancing customer service through chatbots. 🏢 Notably, a staggering 19 of these organizations have established dedicated AI governance structures, demonstrating their commitment to responsible AI practices. 🔐 It's worth mentioning that only 10 organizations collect personal data through AI, and they diligently provide privacy notices to the data subjects involved. 🔍 Impressively, eight out of these organizations conducted privacy impact assessments before implementing AI, ensuring that potential privacy concerns were thoroughly addressed. 💪 All 10 organizations have implemented robust security measures to safeguard personal data, highlighting their dedication to protecting privacy. 🗂 While nine organizations retain the personal data collected through AI, one organization stands out by allowing data subjects to delete their own data, empowering individuals to exercise control over their information. 🔒 Remarkably, no violations of the Personal Data (Privacy) Ordinance (PDPO) were found during the review. This underlines the significance of AI governance, data security, and compliance with privacy regulations, as emphasized by the PCPD. 📜 In line with their commitment to responsible AI development, the PCPD has issued "Ethical Standards for the Development and Use of AI." These standards aim to promote ethical and privacy-conscious AI practices, offering valuable guidance to organizations seeking to mitigate privacy and ethical risks. 🌟 The recommended measures include fostering a culture of compliance, establishing robust internal governance structures, conducting comprehensive risk assessments, and maintaining effective communication channels with stakeholders. Together, these actions will help organizations navigate the complex landscape of AI while prioritizing privacy and ethics.
