Fascinating podcast which was broadcast earlier this year concerning land grabs for the hyper wealthy and the lengths that they will go in order to achieve this. https://lnkd.in/epNtHWae Basically the "Cross Corner" case highlights the complexities surrounding property rights and the use of public and private spaces in America. In this instance, a rich landowner sought to assert control over a piece of land that was historically used by the public for recreation and access. The landowner’s claims rested on the legal notion of property rights, which often emphasizes individual ownership and control over land. The case raised critical questions about the balance between private property rights and public access. It underscored the tension that exists when private land intersects with public interest—especially in areas where communities have traditionally relied on certain spaces for recreation, social interaction, or essential access routes. It would seem that in many parts of the U.S., property law allows landowners significant authority over their land. However, this authority can clash with the rights of the public, particularly when historical usage patterns are considered. The outcome of such cases have often been dependant on local laws, zoning regulations, and the interpretation of easements or public trust doctrines, but will this continue to be the case ?

Berms have been making headlines lately, sparking questions like - who's responsible for them, and why can't we plant fruit trees? TVNZ's Seven Sharp team interviewed Lane Neave Partner and property expert Jaxon Grieve last night to cut through the confusion and find out what's permissible. Jaxon clarifies that councils own the berms, making them responsible for the grass verges. However, most councils rely on the goodwill of residents when it comes to keeping them looking sharp. "Most take it upon themselves to maintain their berm, but it's not a legal requirement." As Dave shared, new master planned communities incorporate wide roads, dog parks and other open spaces as fire breaks between homes and wild areas, creating communities that are fire adapted or fire resilient. When properly sited and planned, these new communities can reduce regional wildfire risk. At XyloPlan our goal is to provide a framework to create and maintain Fire Adapted Communities through high-value, prioritized mitigations, which slow wildfire spread into critical areas. By slowing wildfire, communities are more resilient to wildfire and more able to co-exist with fire in our fire prone landscapes. https://lnkd.in/gSh2bsRj
