To accomplish this, the government intends to establish a new Federal Permitting Coordinator in the Privy Council Office and issue a cabinet directive to enhance coordination between government agencies. Read our policy recommendations: https://bit.ly/4cwQ0XV Win: Through the Cutting Red Tape to Build More Homes Act, the Government of Ontario is proposing a legislative amendment to allow for regulations to broaden the Ontario Energy Board exemption from LTC, for hydrocarbon pipeline relocations or reconstruction. On May 16, 2024, the IRS released Notice 2024-41 (the “Notice”), which provides updated guidance on the domestic content bonus energy credit available for qualifying energy projects under the Inflation Reduction Act of 2022 (the "IRA"). The Notice modifies existing guidance on the domestic content bonus under Notice 2023-38 (“Notice 2023-38”) and establishes a new elective safe harbor (the “New Elective Safe Harbor”) that allows project owners to determine certain projects’ eligibility for the domestic content bonus using predetermined cost percentages provided by the IRS. Breaking!!! 🚨 🚨 By a vote of 15-4, Senator Manchin's and Senator Barrasso's Energy Permitting Reform Act of 2024 passed the U.S. Senate on Energy and Natural Resources Committee earlier today. The bipartisan bill aims to expedite federal authorizations for energy and mineral projects by shortening timelines before, during, and after litigation, while preserving existing rights for judicial review. It introduces a 150-day statute of limitations from the date of the final agency action on a project, requires courts to expedite the review of legal challenges, and mandates federal agencies to act on remanded authorizations within 180 days. If passed in the Senate, this bipartisan legislation could mark a significant advancement in accelerating permitting processes and providing greater certainty for energy and mineral projects in the U.S., while maintaining essential protections for the environment and affected communities.
