As expected, the FTC's authority to regulate #noncompete clauses is being #challenged. But there is still a beacon of hope. The Workforce Mobility Act of 2023, a bipartisan bill introduced to Congress on February 1, 2023, offers a promising alternative solution. If enacted, this legislation would prohibit non-compete clauses nationwide, with limited exceptions. Under the bill, employers would be required to display a notice in a conspicuous place, informing employees of their rights. The #FTC and #DepartmentofLabor would oversee enforcement, with the option for private action in federal court. While the FTC's authority may be in question, there is still a beacon of hope. The #WorkforceMobilityAct offers a robust solution to address the harmful effects of non-compete clauses. Let's see what happens!

Litigating noncompete agreements has been a large part of my practice now for many years. This ruling will have sweeping repercussions on the employment world. We'll be preparing a memorandum to clients analyzing the contours of the new rule, its implications for employment agreements in the years to come, as well as the federalism implications (and likely challenges) that will ensue.
