Hey Founders and CTOs, What does non-obviousness for patents means? Not so obvious, Eh! Think of it this way: ⚡ A patent can't be awarded for something so simple and predictable that any person skilled in your field would have easily come up with the same idea. Your invention needs to be a significant step beyond what's already known. Here's how the patent office determines non-obviousness: ➡ They consider the existing knowledge in your field, also known as "prior art." ➡They imagine a hypothetical person skilled in that field (let's call them "Bob the Inventor"). ➡Then, they ask: Would Bob the Inventor, using only prior art, have come up with your invention without much trouble? Why is non-obviousness important? The goal of patents is to encourage innovation. 💡 If someone could have easily figured out your invention based on existing knowledge, it wouldn't be considered a true advancement. So, how do you make your invention non-obvious? ➡ Highlight unique features: Focus on the aspects of your invention that are genuinely new and solve problems in a novel way. ➡ Don't be obvious in your approach: Even if the core concept exists, demonstrate a surprising or unexpected solution. ❗ Remember: A simple combination of existing technologies might not be enough for non-obviousness. The good news? ✨ Even if your invention isn't quite there in terms of non-obviousness, talking to a patent attorney can help. They can advise on ways to strengthen your application and showcase the unique aspects of your invention. Don't let non-obviousness be a roadblock! 🏔 Refine your invention, showcase its innovative features, and with a little strategic planning, your patent dreams can become reality.
