Our Head of Scotland William Devine reflected on the impact of the business insolvency peak in a recent article for The Scotsman. For businesses, access to funding remains a critical issue amongst other challenges such as inflation and supply chain uncertainty. ☑️ Nevertheless, William outlines that by fostering a dialogue with funders and championing regional development initiatives (alongside refinancing and debt restructuring options in some cases), we might help to begin averting looming concerns of insolvency. 💬 “Despite the prevailing headwinds, there's determination to weather the storm and emerge stronger on the other side. As we progress through the economic cycles, it's this spirit of resilience that serves as a promise for the future of Scottish business.” Read the full article here: https://lnkd.in/eHSDg_ST #ScottishBusiness #BusinessNews #SME #AssetFinance

Co-hosted a great panel discussion last night with Wiggin and Dana LLP and a group of local #Westport-area entrepreneurs! The discussion covered: 1) The M&A environment, how activity is picking up and recent trends in deal negotiations including risk allocation issues and key considerations for buyers. 2) Considerations for sellers in an M&A transaction, from #LOI to close, and post close, and key issues relating to #earnouts, rollover equity, seller note, and post-closing employment and restrictive covenants. 3) Pre-transaction planning: Assembling your team of advisors, evaluating income tax opportunities such as #QSBS structuring and stacking, and implementing estate planning vehicles, such as trusts and LLCs, to transfer wealth while taking advantage of #valuation discounts available at each stage of a business’s life cycle. 4) How to “always be ready” to sell, maintaining clean records, datarooms and corporate governance can set you up to be opportunistic if you’re approached by a buyer. wiggin(x) #entrepreneur #pretransactionplanning #wealthplanning
