TIP OF THE WEEK . Understanding lawful and unlawful salary deductions is crucial for both employers and employees. According to the Basic Conditions of Employment Act (BCEA), specifically, Section 34, employers can only deduct an employee’s salary with written consent or if mandated by law, a collective agreement, court order, or arbitration award. . Key points to remember: . 1. LAWFUL DEDUCTIONS: include statutory contributions (UIF, PAYE), union subscriptions, court-ordered garnishee orders, and reimbursements for overpaid wages or staff loans with proper agreements. . • Conditions for Reimbursement Deductions: - Loss or damage occurred during employment due to the employee's fault. - A fair procedure was followed, giving the employee a chance to contest the deduction. - The debt amount does not exceed the actual loss or damage. - Deductions do not exceed 25% of the employee’s remuneration. . • Types of Statutory Deductions: - Unemployment Insurance Fund (UIF) - Pay-As-You-Earn (PAYE) - Provident fund - Leave pay . • Other Permitted Deductions: - Overpaid wages or money - Staff loans with a written agreement - Union subscriptions from collective agreements - Garnishee orders by court . 2. UNLAWFUL DEDUCTIONS are those made without employee consent or as fines imposed for misconduct. . It’s essential to follow fair procedures, ensuring deductions do not exceed one-quarter of the employee’s remuneration. Remember, disputes over these deductions fall under the Labour Court's jurisdiction, not the CCMA. .
