Interesting to read reports in the German Press that Europe’s football regulator, UEFA, will provide for in its Rules - in addition to the Court of Arbitration for Sport (CAS) in Switzerland - a right to an appeal in Ireland, hence allowing for arbitral awards to be appealed to a domestic European Union (EU) court and, as necessary, referred to the Court of Justice of the European Union (CJEU) in Luxembourg. This is the logical consequence of last December’s CJEU decision concerning the International Skating Union (ISU) that the CAS does not currently provide for an effective remedy in sports cases giving rise to competition law points. It also reinforces the recent trend of the courts’ intervention in sport, which were otherwise historically very reluctant to do so.

BALLINNO 0 – UEFA/KINEXON 1 The Unified Patent Court (TUP) 👩⚖️ has rejected the request for precautionary measures seeking the use of video referee (VAR) technology at EURO 2024 in Germany ⚽ . Although this “reporter” 🤓 has not yet had access to the grounds of the Decision, it appears (from what has emerged in other media) that the Hamburg local division of the Court has not considered the existence of periculum in mora (urgency in the adoption of the measures), nor fumus bonus iuris (appearance of infringement of Ballinno's patent) ⛔ . The Decision can be appealed, but considering the processing times, it can be said that the VAR may continue to be used in the EuroCup, at least in this edition 😅 . 🤜 🤛 On the other hand, the nullity action that Kinexon filed against Ballinno's European patent before the Central Division of Paris is processing. We will see (not before the end of the EuroCup) how this case finishing. These types of issues are always very high-profile, but this makes it possible to publicize the importance that in the practice an IP right can present and the significance of an action of this magnitude 😱 . Situations like this can also occur due to the launch of new mobile terminals at the time of the Mobile World Congress or even the paralysis of the assembly line of a car or the distribution of a medicine, which requires obtaining specialized and experienced advice in this type of matters, as the one that ABRIL ABOGADOS has been providing to its clients for years 😎 . With the UEFA EURO 2024 well underway, we've been wondering what preparations were required to get the German stadiums and fan zones in tip top technical shape, ready for the masses who were about to descend on the German cities. It seems that Deutsche Telekom led the charge with major 5G upgrades in all ten stadiums, installing 750 new 5G antennas. It's no surprise that mobile connectivity is the key focus with promised data throughput speeds of up to 1.2Gbit for the fans which seems to be a substantial improvement over previous capabilities. Fixed connectivity also wasn't ignored, with 65km of new fibre, over 900 additional switches and over 1,300 access points newly installed to ensure sufficient capacity for the worldwide media coverage. If Deutsche Telekom are capable of all that, getting England to the final shouldn't be too difficult, right?!
