On Jan. 16th, following a lengthy hearing, O’ahu First Circuit Court Judge Gary W.B. Chang dismissed our elephant rights case to free Mari and Vaigai from the Honolulu Zoo following a 45-minute hearing. While we obviously disagree with Judge Chang’s decision, we appreciate how probing his questions were, his philosophical approach to the arguments overall, and the fact that he heard arguments at a very early stage in our clients’ case. Judge Chang’s thoughtfulness is an indication of how seriously courts are now taking the issue of nonhuman animal rights. That said, Mari and Vaigai are entitled to have the injustice of their imprisonment remedied through the writ of habeas corpus, which is meant to safeguard the freedom Mari and Vaigai have been denied. We plan to appeal Judge Chang’s decision because the law and the science are clear: habeas corpus isn’t limited to humans, and Mari and Vaigai will continue to suffer until they’re released from their unlawful imprisonment in the Honolulu Zoo and can regain their freedom in an elephant sanctuary. In November, the NhRP filed a habeas corpus petition in the O’ahu First Circuit Court on behalf of Mari and Vaigai. The first litigation of its kind in Hawaii, the NhRP’s habeas corpus petition has the support of world-renowned experts in elephant behavior and cognition. Mari and Vaigai were born in the wild in India, taken from their herds when they were young, and imported to the US in 1982 and 1992, respectively. Both were given to the municipally-owned Honolulu Zoo as a gift from the Indian government and then Prime Minister Indira Gandhi. The City and County of Honolulu, Department of Enterprise Services, its Director Dita Holifield, and Honolulu Zoo Director Linda Santos are named as respondents in the lawsuit. “Captive CON$ervation” Is it time to break with colonial legacy of zoos? Published in 2016, but remains a relevant and compelling discussion today: “Menageries of the 19th century brought exotic animals (and people) to Western society – as do many zoos today. The shooting of Harambe the gorilla at the Cincinnati Zoo has reignited debate about how to properly care for and conserve zoo animals. Several petitions have been created on Change.org, seeking some form of justice for Harambe. Given the conservation mission of the modern zoo, there is much discussion about how we might make zoos better to prevent an event like the one that led to Harambe’s death.” “Zoo visitors have learned the rules of the game – animals are enclosed, not caged; animals are in the enclosure, people are not. Exotic places, animals and people are neatly represented in essential ways. The desire to conform the world to one of our own narration is an articulation of the colonial project.” “But what if the entire premise of zoos is to blame? Instead of seeking justice for Harambe, or improving zoo policies or exhibit design, we should first ask what, precisely, are we conserving in zoos? In my view, we are perpetuating an outmoded worldview rooted in colonialism.” Complete Article: https://lnkd.in/gUcYaSmw #captiveconservation #nomorezoos #TheConservationGameMovie

Captive CON$ervation: "Project Survival Cat Haven” is a unaccredited roadside zoo located in Dunlap, California. The facility continues to breed and purposefully human-imprint exotic species of cats, to include cheetahs, mountain lions, clouded leopards and servals. Some of these sentient creatures are exploited as “ambassador animals”, tethered to a leash for onsite/offsite events and photo-ops. In December of 2023 the USDA cited Project Survival Cat Haven for violating USDA/APHIS standards for the transportation of a juvenile cub, stating: “In October of 2023, the facility transported an approximately 6 week old mountain lion cross-country in a vehicle, the animal was outside of a primary enclosure for portions of the trip. In video documentation, facility staff can be seen holding the animal in their laps and placing the animal on the floor of the moving vehicle with no other form of restraint or control.” Note: Shortly after arriving at Project Survival Cat Haven, the juvenile mountain lion was put on display in the roadside zoo’s gift shop. It is egregiously irresponsible to suggest that allowing the public to take “selfies”with such sentient-beings enriches said animals lives and/or helps to sustain their counterparts in the wild. Interacting with or exhibiting sentient creatures at the end of a leash for on/offsite events and behind the scenes encounters/photo-ops misguided the public into believing that exotic animals can or should be domesticated. Today begins National Wildlife Week. To kick off this week, let’s pay homage to the bison, which played an important role in Métis daily life. From 1810-1870, the plains bison was a symbol of survival and prosperity. The Métis’ deep connection to nature was woven into every aspect of their life. The Métis utilized every part of the bison, embodying the spirit and harmony with the land. Hides were used for clothing and blankets while embracing warmth and tradition. Skins were crafted into bags and ropes, carrying stories of resourcefulness. Bones transformed into knives and tools, a testament to their ingenuity. Horns evolved into spoons and ladles to create delicious traditional recipes. The meat, serving as valuable trade and sustenance, nurtured both physical well-being and social connections within the community. The Métis harmonized with the changing seasons, engaging in bison hunts twice a year. Image: White Bison at the Visions, Hopes and Dreams Wildlife Park. New book review is live: Entangled Encounters at the National Zoo In Entangled Encounters at the National Zoo: Stories from the Animal Archive author Daniel Vandersommers explores the evolution of the National Zoo as well as the far more limited evolution of society’s empathy for the animals within its walls. The National Zoo opened in 1891, thanks in large part to the advocacy of William Temple Hornaday, whose life as a hunter had taught him that the American bison were at risk of going extinct. He urged his employer, the Smithsonian, to purchase a few bison in order to help save the species. And that’s just what they did, keeping six bison on the back lawn of the Smithsonian Castle. Soon after, people began dropping off animals, some wild, some domestic, and Hornady worked to get funding to build a zoo, under the auspices of conservation, education and science. The National Zoo was not the first zoo in the US (Philadelphia came about nearly two decades prior). By 1901 the author notes that there were 56 zoos across the country. While this book is about one zoo, it could in many ways be about any zoo. As Vandersommers writes, “The zoo always produced opposing experiences, as well as sublimated ones.” Indeed it is very difficult to read the many stories of animal captivity, escape and premature death at the hands of inept handlers, not to mention the many horrible ways that visitors treated animals. I used to think that the occasional stupid visitor story was more a product of our selfie-driven world; but there were stupid visitors doing stupid things to animals long before portable cameras. It’s not surprising that animals wanted out of zoos. Within the Zoo’s first year we witness the first escapee — a brown bear. The bear was soon killed and the news made headlines, which, as the author notes, actually fed into the aura of the zoo itself. Vandersommers writes, ” …by running away, zoo animals gave the public that dose of ‘the wild’ that it craved, as well as, upon capture, the relief of control that it was programmed to want. Runaway animals accomplished all of this as they sought to escape the zoo.” More: https://lnkd.in/gBzVpkZ8 #zoo #animalhistory #animalrights #smithsonian
