Every state has their own laws pertaining to the protection of persons and property. In North Carolina the law pertaining to private protection is N.C.G.S 74C- Private Protective Services Act. I will provide a basic breakdown of the main points as it relates to this statute. It will be paraphrased and shortened. I am not a lawyer.
74C-1 Purpose- To increase the performance and reliability of all professions under the PPS umbrella for the public good.
- 2/4 There is a PPS Board that determines licenses issued and you must have the proper license and training to perform PPS duties.
-3 These are PPS Professionals - Armed armored car, Bodyguard/Exec Protection, Armed courier service, Private lie detection, digital forensic, counter electronic, Security guard/patrol companies, Guard dog service, Private detective/investigator, alarm response (armed).
Professions NOT considered PPS- Government employees at any level while conducting their duties, Employee undercover in a job on behalf of a different employer, Proprietary security (must register with PPS if armed), Asset protection specialists, and Search and Rescue EMT.
-5 PPS Board may establish standards and control licensing for PPS activities.
-6 PPS Board has a Director in charge.
-7 Secretary of public safety may investigate violations in regard to this chapter.
-8 To perform duties you must apply to the board for a license. Applicants must be 18, good morale character, and their criminal history will be judged when determining their application.
-9 License is good for 2 years.
-12 The board may deny, revoke, or suspend a license for immoral and criminal behavior.
-13 Armed employees must have the required firearms training and registration permit set by the board. This includes contract, proprietary (register armed guards same as PPS), investigators, and armored car.
-15 Must have licensee card on person at all times while on duty.
-16 Lying about being licensed is a crime
-17 Any person or organization violating the provisions of this chapter is guilty of a Class 1 misdemeanor, up to a $2000 fine and subject to their licensing being revoked.
-18 Licensing and experience in other states can be taken into account for a temporary working permit.
-21 Police do not need to be licensed as PPS Detective or Guard. Police cannot be on duty or use their police equipment when engaged in their PPS Job.
-22 The board can establish a continuous education requirement.
