Hey Sameer Nigam, First off, I just want to say I absolutely love how PhonePe makes payments so easy and hassle-free. It’s such a game-changer! That said, I’ve noticed something about the chat feature that might need a little tweaking—especially from the perspective of women users. It can be pretty unsettling to get random messages from people we've transacted with. Safety and comfort matter a lot, right? Here are a few thoughts I had that could make the experience better for everyone: -An option to disable chat altogether for those who don’t want it. -Time-limited messaging—like allowing messages only for a short window after a transaction. -Spam filters powered by AI to catch and block any unwanted or inappropriate messages. I think these changes could really help make the platform safer and more user-friendly. Over the past few days, like many privacy practitioners, I’ve been analyzing the much-anticipated Digital Personal Data Protection Rules, 2025, which are touted as groundbreaking regulations aimed at fostering a privacy-centric culture in India. Here are my thoughts: 1. Consent as the Primary Legal Basis According to the Second Schedule of the Rules and Section 7(b) of the Act, consent is the cornerstone for data processing. However, consent poses challenges as it can be withdrawn at any time, and there is often a power imbalance between the consenting parties. Shouldn't the Rules establish additional lawful bases for processing to address these issues? 2. Grievance Redressal vs. DPO Mandate Basis Rule 9 and the Second Schedule, grievance redressal is mandatory for all Data Fiducuiaries (DF) however, as per Chapter 2, Section 10 (2) of the Act, the position of a Data Privacy Officer (DPO) is mandatory only for a Significant Data Fiducuairy (SDF). But the big question remains, what is the threshold of differentiating between a DF and an SDF? 3. Consent Manager vs. DPO The First Schedule suggests that the Consent Manager is granted authority comparable to, if not greater than, that of a DPO. Is this an attempt to create another business vertical, or does it reflect a strategic shift in privacy governance? 4. Limited Scope of DF Classifications The Third Schedule categorizes Data Fiduciaries into sectors like E-Commerce, Gaming, and Social Media. But why stop there? Why not extend the classifications to include other industries that extensively handle Personally Identifiable Information (PII)? In conclusion, while the intent behind these Rules is commendable, there’s significant room for improvement, especially considering the Government took over a year to finalize them. The potential misuse of parental data by minors to bypass consent processes introduces new risks. Implementing a tiered consent approach akin to GDPR's threshold could enhance practicality and child safety while reducing compliance complexities. - 𝐍𝐨𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐃𝐚𝐭𝐚 𝐁𝐫𝐞𝐚𝐜𝐡 – 𝐖𝐢𝐭𝐡𝐨𝐮𝐭 𝐃𝐞𝐥𝐚𝐲: The directive for immediate breach notifications lacks explicit timelines, unlike GDPR's specified 72-hour window. The ambiguity of "without delay" may lead to varied interpretations and inconsistent enforcement. Establishing clear timelines would provide organizations with clarity and promptness in response. - 𝐒𝐩𝐞𝐜𝐢𝐟𝐢𝐜 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧𝐬 𝐟𝐨𝐫 𝐒𝐭𝐚𝐫𝐭𝐮𝐩𝐬 : The absence of explicit exemptions for startups burdens smaller enterprises with the same compliance standards as larger corporations. Introducing a risk-based compliance framework that aligns obligations with the scale and sensitivity of data processing activities would be more conducive. - 𝐈𝐧𝐜𝐞𝐧𝐭𝐢𝐯𝐞𝐬 𝐟𝐨𝐫 𝐏𝐫𝐨𝐚𝐜𝐭𝐢𝐯𝐞 𝐂𝐨𝐦𝐩𝐥𝐢𝐚𝐧𝐜𝐞: Recognizing and incentivizing proactive compliance measures, such as reducing penalties for early adopters of privacy-by-design principles or offering certifications, would encourage adherence to regulations. - 𝐒𝐭𝐫𝐞𝐚𝐦𝐥𝐢𝐧𝐞𝐝 𝐍𝐨𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐑𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬: The current breach notification criteria lack clarity and may inundate users with unnecessary alerts, leading to notification fatigue. Limiting notifications to scenarios posing significant risks to individuals would ensure effective communication and prevent user overwhelm. The DPDP Draft Rules for 2025 represent a significant stride towards privacy protection in India. Enhancing these rules with precise definitions, realistic timelines, and strategic incentives can strike a harmonious balance between privacy, innovation, and operational viability. There’s a lot of organisations need to get a systemic grip on #GDPR. Recent experience leads me to believe many people are either frightened of it or ill equipped* to make a sensible decision on how it applies to their domain. The main reason I’m posting now, though, is because I had a Domino's delivery driver call at my door, with a pizza I hadn’t ordered. He gave my address, so I asked him to check the name. Apparently they don’t record names on their deliveries, “due to GDPR”. Seriously. That’s like Amazon Business not delivering parcels with people’s names on them. (*ill equipped - usually where the decision is made by a mid/senior manager who can’t or won’t get a specialist to advise, and, rather than get it right, covers their back instead)
