This from Ash Morgan on fixed recoverable costs in English litigation. It’s been on the agenda for years but never implemented in higher value claims. That’s presumably because it’s unpalletable to many in the industry. The only place in the world with more litigation lawyers is the US where often there is no costs recovery at all. But the US tends to have far larger damages awards driven by the jury system. One thing is clear- if the loser did not have to pay the costs there would be greater access to justice albeit Volvo rather than Rolls Royce. One other thing is clear. By comparison with the arbitration institutions, High Court litigation now looks pitifully cheap. The 10k cap should be increased to 100k or removed altogether.

Breaking News for Hernia Mesh Litigators! If you came here looking for news, you have news. Two significant filings have occurred: 1. New Court Order: A stay has been put on all hernia mesh lawsuits in the MDL. This stay can be lifted for cases where plaintiffs opt out of the Master Settlement Agreement, indicating that there is a settlement agreement in place. 2. Initial Requirements: Another order outlines some initial requirements for plaintiffs opting out of the settlement. Although the settlement details haven't leaked yet, these orders strongly suggest a settlement is happening. Stay tuned for more information as it becomes available. Latest Update: For hernia mesh lawyers, June was a month of intense activity, with 745 new lawsuits filed. This rush is driven by the uncertainty of the cutoff point for cases to be included in the settlement, but it's certain that filed lawsuits will be part of it. Recent Developments: Two law firms filed a joint motion with Bard to seal their hernia mesh settlement terms from the public, arguing that public disclosure would impact other settlement negotiations. This confirms what we've been hinting at: some firms have settled with Bard. Previously, details of these settlements were rumors, but this motion has made it official.
