Finally, the new Swiss-US data protection framework will come into force on 15 September 2024. 🔶 Whether a certain US-entity has been certified for the data involved in the transfer, must be checked on a case-by-case basis. 🔶 Data transfers to US-companies that are certified under the renewed framework will, in principle, be possible without further guarantees, however not without appropriate technical and organizational measures. 🔶 The lawfulness and data protection compliance of the data processing activities associated with each data transfer must itself be assessed separately and is as such not covered by the certification under the framework. 🔶Companies relying on the transfer mechanism of the renewed Swiss - US framework should be aware of and be prepared for the potential invalidation of the framework as we have seen in the past, namely the Schrems decisions. Get cracking with the DPDPA law says MEITY and don't wait for the rules. Change is always difficult and complex, but inevitable. With the free flow of data, we have let ourselves be part of a monoculture of big businesses - collect data, harvest, and indiscriminately target consumers, with little or no regard for privacy. When the DPDPA law was published in August 2023, there was a buzz but it soon fizzled out arguing that the rules needed to clarify many things (and led to this delay so far). Besides, many Clients I have spoken to - while agreeing with the law - have vehemently opposed anything leading to data limitation and data minimisation. Viewing this from their point of view, the fear stems from the fact that if such detailed access to data is unavailable, their growth would be curtailed. Nothing could be further from the truth.
