The current and former state attorney generals and the current and former governors of Oregon should be the first state public officials in America charged and jailed under Trump's order to detain local officials for federal immigration crimes and illegal sanctuary policies. Before you get lost in the weeds of executive orders, and all the #immigration news with Trump’s first day Keep this in mind: the goal is fear, not policy. As an immigration attorney who spent four years litigating against the Trump administration's policies, I think the best indication of what Trump’s immigration plans will look like is family separation No plans, just cruelty and fear. That’s what we can expect. So what do we do? Stay calm. Remain focused. Be methodical. Infuse all of our work with professionalism. We survived Trump 1.0. We will survive whatever he’s got for us this time.

Could Mass Deportation Really Happen? With President-elect Trump set to take office in January, considerable attention is focused on his administration’s proposed large-scale deportation plans. Promising to carry out what could be the largest deportation effort in U.S. history, the initiative faces numerous legal, logistical, and financial challenges that may impede its execution. 🔍 Key Challenges to Consider: Legal Limitations: President Trump has proposed invoking the Alien Enemies Act of 1798 to expedite deportations. However, experts note that this act applies only during a formal state of war with an enemy nation—a status the U.S. does not currently hold. Historically, the act has been used only three times, each during declared wars. Attempting to use it now would likely encounter significant constitutional challenges, particularly concerning due process and equal protection. Resource Constraints: Deporting millions of individuals (estimates range from 11 to 20 million) would require substantial resources. The federal government has consistently struggled with budgetary and manpower constraints in enforcing immigration laws. Both Democratic and Republican administrations have faced these challenges, limited by funding and logistical capacity in managing immigration enforcement on a large scale. Impact on Local Governments and Sanctuary Cities: The administration has suggested increasing collaboration with local law enforcement through 287(g) agreements. However, sanctuary cities and states may resist these policies, creating additional legal and logistical complications. Threats of funding cuts to non-compliant jurisdictions could also lead to legal battles between federal and local governments. Economic and Social Consequences: Mass deportations could deeply affect industries heavily reliant on undocumented workers, including agriculture, construction, and hospitality.
