The 26th Constitutional Amendment, recently passed by Pakistan’s Parliament, marks a significant challenge to the independence of the judiciary—an issue highlighted by the International Commission of Jurists (ICJ) in their recent statement. This amendment raises serious concerns about its implications for the rule of law, judicial impartiality, and democratic integrity in Pakistan. The judiciary serves as the cornerstone of a fair and just society, acting as a neutral arbiter between the government and the people. When judicial independence is compromised, the balance of power tilts, allowing the executive and legislative branches to potentially influence judicial outcomes. This can lead to biased judgments, the erosion of checks and balances, and ultimately, the weakening of democracy itself. According to the ICJ, the 26th Amendment is a direct threat to these principles as it undermines judicial autonomy. The ability of judges to operate free from political pressure is essential in ensuring that justice is delivered impartially. Without this independence, the judiciary cannot effectively act as a safeguard against arbitrary decisions by the government, which can impact everything from civil liberties to economic rights.

In the most recent blog post, published at #50shadesoffederalism, together with professor Jens Woelk, we discuss the European Commission priority on status of foreign judges at 🇧🇦 Constitutional Court and propose a new method of selecting three foreigners at the Court. ▶️ https://lnkd.in/ebdjHP5w In my earlier post for the IACL-AIDC, I have considered four key issues behind the debate on the future of foreign judges, concluding that foreigners still have a decisive role to play in post-conflict BiH state building. ▶️ https://lnkd.in/epq9Ndfa #constitutionalcourt #foreignjudges #euintegration

As our Parliament discusses the proposed 26th Amendment to the Constitution, focusing on altering the superior judiciary's functioning, it's crucial to uphold the rule of law and independence of judiciary. In Pakistan, respecting court decisions and ensuring an impartial judiciary are vital for citizens' rights and trust in state institutions. Rushed amendments risk undermining justice - "justice hurried is justice buried." Constitutional reforms impacting the judiciary require thoughtful consideration. Hasty changes jeopardize the freedoms and justice that define our nation. The rule of law is a fundamental necessity, not a privilege. Therefore, any constitutional revisions must strengthen, not weaken, the judiciary's independence and people's rights.

I'm delighted to have participated in the webinar on 'Amendments in the Constitution of Pakistan 1973,' organized by the Law Student Foundation. The session critically examined constitutional reforms, echoing concerns similar to those surrounding the 26th Constitutional Amendment Bill currently under discussion. Just as the proposed bill threatens to fundamentally reshape Pakistan’s judiciary—by transferring the Supreme Court’s original jurisdiction to a new constitutional court heavily influenced by the executive—the amendments to the 1973 Constitution also provoke questions about the balance of power. The creation of a court where judges are handpicked by political figures, effectively sidelining the judiciary's role in constitutional interpretation, reflects the core issue discussed during the webinar: the need to safeguard judicial independence. Much like the 26th Amendment’s proposal to abolish the Supreme Court’s role in key constitutional petitions, these amendments challenge the very foundations of democracy. By diluting checks and balances, both sets of changes pose the risk of executive overreach. Thought-provoking discussions like this help us grasp the potential consequences and highlight the importance of maintaining a robust judicial system to preserve our nation's democratic principles. #ConstitutionOfPakistan #RuleOfLaw #26thConstitutionAmendmentBill #JudicialIndependence
