Last week, a Texas federal judge blocked the Federal Trade Commission's nationwide non-compete ban, which was set to take effect in September. The court ruled that the FTC exceeded its authority by imposing such a sweeping prohibition. For now, employers can continue to enforce their non-compete agreements, but attorneys Kelsey Gee and Jennifer Huelskamp advise employers to review their current agreements to ensure compliance with state laws as the legal battle continues. For many of us who operate in critical areas the joys and trials of Non-Compete clauses are a way of life. Also the subject of much litigation. I have been subjected to it multiple times. Well it seems the FEDS are going to take a stab at clarifying what is permitted and what is not. I suspect that this will strike a certain fear amongst some law firms. Interesting twist in the #noncompete saga. Honestly I was wondering about the legal basis for the FTC to issue a rule that de facto applied to all private contracts. I can see both sides of the noncompete issue having been on both ends of them. I think there are other more surgical ways to protect what is really at stake for a company releasing an employee - IP, CBI and trade secrets. We shall see!

⚖ 🗣 On August 20, the U.S. District Court for the Northern District of Texas issued a significant ruling in Ryan, LLC v. Federal Trade Commission, 𝐛𝐥𝐨𝐜𝐤𝐢𝐧𝐠 𝐭𝐡𝐞 𝐞𝐧𝐟𝐨𝐫𝐜𝐞𝐦𝐞𝐧𝐭 𝐨𝐟 𝐭𝐡𝐞 𝐅𝐓𝐂 𝐑𝐮𝐥𝐞 𝐭𝐡𝐚𝐭 𝐰𝐨𝐮𝐥𝐝 𝐡𝐚𝐯𝐞 𝐛𝐚𝐧𝐧𝐞𝐝 𝐧𝐨𝐧𝐜𝐨𝐦𝐩𝐞𝐭𝐞 𝐚𝐠𝐫𝐞𝐞𝐦𝐞𝐧𝐭𝐬 𝐧𝐚𝐭𝐢𝐨𝐧𝐰𝐢𝐝𝐞. The FTC is expected to appeal, and the case may eventually reach the Supreme Court of the U.S. Employers should stay vigilant and continue reviewing their non-compete agreements to prepare for any potential future changes. It looks like we will have a delay in the Non-compete ban. On August 20, 2024, the United States District Court for the Northern District of Texas issued a Decision and Order in Ryan, LLC v. Federal Trade Commission, barring the enforcement and implementation of the FTC Rule that would have banned non-compete agreements. As such, the FTC Rule banning non-competes will not be enforced or take effect on September 4, 2024, as originally scheduled. Unlike the Court’s previous ruling, this new Decision and Order applies nationwide. In its Decision and Order, the Court ruled that: In promulgating the rule banning non-competes, the FTC exceeded its rulemaking authority with respect to unfair methods of competition. The rule was arbitrary and capricious because it was unreasonably overbroad and based on inconsistent and flawed empirical evidence #ems #emsnow #ipc #smta #noncompete #texas
