EMPLOYER LAWYER UPDATE: A federal court in Texas has issued a preliminary injunction to stop the enforcement of the FTC’s noncompete ban…. 🛑 🛑 BUT that only applies to the parties in that case at this point. 🛑 🛑 While that ruling is not that helpful to all other employers and employees out there trying to plan for the expected effective date of September 4th, it does tell us that the Texas court believes there is a substantial likelihood of success on the merits of that challenge. We expect the Texas court’s decision on the merits by the end of August. 👀 👀 Meanwhile, we are keeping a watch on the challenge in Pennsylvania. With a hearing scheduled for tomorrow, we are hoping to soon learn if that court will issue a consistent ruling, or perhaps issue a broader, nationwide stay. #employerlawyer #employmentlaw #businessandmanagement #noncompetes #humanresources
