By leveraging the patent opposition system, you can effectively resolve these issues and clear the path for smooth business operations.   Japan’s patent opposition system allows anyone to file an opposition against a patent decision within six months of the patent publication date. Once an opposition is filed, the Japan Patent Office will carefully review whether the patent should be maintained or revoked. While the rate of revocation decisions is around 10%, it is important to note that about 70% of patents maintained after opposition involve adjustments to the scope of rights by the patent holder.   Given the prevalence of excessively broad patent claims due to Japan’s pro-patent policies, filing an opposition can be an effective strategy to compel the patent holder to narrow the scope of their rights.   Additionally, since anyone can file an opposition, it is possible to submit an objection anonymously. Why are European Patent Attorneys so cheap? Having seen some worrying articles on the number of new entrants to the patent profession in Europe I decided to do my own research on what is actually happening and I’ve made a graph. The number of successful candidates for a given year comes from the EPO’s EQE page, and the number of applications filed comes from the EQE’s statistics page. While the trend over the past four years looks alarming, it looks to me that this averages out and is down to the backlog of candidates in the system due to the EQEs not being held in 2020 due to covid. 2024 looks like a return to normal. When averaged out, the number of patent attorneys entering the profession looks flat, but, against that, the number of patent applications being filed has been going up. To me, if this trend were to continue it looks like there would be shortage of Europe Patent Attorneys at some point in the future (if there isn’t one already). In my experience, prices have also stayed reasonably static over the same period. But if the number of applications is going up, and the number of Attorneys is staying the same, prices should also be going up due to increasing scarcity. So this leaves me with a question: - why are European Patent Attorneys so cheap?   PS I’m sure the AI revolution will affect the number of trainees sitting the EQEs. But what will the effect be? How to protect your #IntellectualProperty ? When to apply for a #Patent? We hear those questions a lot. Let’s dive in. #PATENT vs #TRADESECRET While patents are commonly used to protect valuable #IP, financial and legal burden is substantial to secure the patent and enforce it. Trade secret is an alternative, quite the opposite approach. Instead of telling the entire world about your invention, you … keep it secret! ✅ In our experience, Rule of thumb in making patenting / not patenting decision comes down to: do you have resources to protect your patent in court if someone infringes? Smaller companies might decease once you bring the IP claim but bigger companies may go to court and this process can go forever. ✅ If your idea is valuable enough and you have resources to A) secure and B)enforce your patent in court, go for it. Otherwise, consider trade secret approach or provisional patent application. 💡Also, in most cases, startups pursue patent applications to have stronger position for #fundraising. Investors and #VC do care about patents IF (and only if) your product has proven potential for substantial market share. ‼️As you pursue patent applications, don’t forget to actually build stuff. So, what can (and can't) be patented? 1. Can be patented: Machines, devices, compositions of matter, processes, and improvements to these. Think new medical treatments, innovative gadgets, or unique chemical formulas. 2. Generally can't be patented: Abstract ideas, natural phenomena, laws of nature, and mathematical algorithms. You can't patent gravity, unfortunately!
