Remote work is usually not a right. Under the National Employment Standards, some will have a right to request flexible work (if they meet the minimum service, and at least one other criteria). But the right is to make the request. It is for the employer to decide whether that request is granted. The Fair Work Commission recently considered a case where an employee wanted to work entirely remotely. The employer offered a mostly remote arrangement but insisted on one day per week in the office. The employee continued to work entirely remotely. This matter found its way before the Fair Work Commission to consider a dispute about the employee's flexible work request. And while there were questions as to whether the employer had reasonable business grounds to refuse the employee's request, the Commission frowned upon the employee's unwillingness to cooperate, and reiterated that: "[41] There is assumption by the Applicant that he is entitled to be working a flexible working arrangement without an approved request. This assumption is incorrect. Employees are to follow a lawful and reasonable direction until the request for a flexible working arrangement is granted."
