Personal identifying medical details about an individual's physical or mental well-being in the present, past, and future comprise PHI, and both paper-based and electronic versions are available. Safeguarding patients' privacy and complying with HIPAA regulations necessitate the precise identification of PHI, and ensuring that all workforce members know about recognizing PHI and how to handle sensitive health information securely are significant steps towards safeguarding patient privacy within healthcare institutions. ★ HIPAA aims to preserve individuals' personal medical data privacy and security while ensuring the swift sharing of electronic healthcare information. Compliance with the legislation is mandatory for covered entities, including medical service providers like clinics, hospitals and business associates dealing with patient data. ★ HIPAA's core features include the Privacy Rule, which subjects the use and disclosure of PHI to this rule for covered entities. One of the rights granted under this law is the ability for individuals to review and modify their medical records, and written consent from patients is mandatory for covered entities to access or disclose their PHI unless it is related to treatment payment or operating the healthcare facility. Moreover, requiring notice of both patient privacy rights and an entity's practices is a crucial provision within the Privacy Rule.

If a patient requests medical records via email and you do not use a secure email system, can you send it unencrypted? The general principle of HIPAA security and privacy laws and rules is to protect the patient’s protected health information (PHI) from unauthorized disclosure to third parties. In theory, if the patient consents to insecure transmission of their data, you would be able to provide it. In “Your Patient Wants Records Sent Via Unsecure Email. Are You Covered?”, published by Part B News, Rich Cahill, JD, Vice President and Associate General Counsel, The Doctors Company, part of TDC Group, provides recommendations for how to respond when patients request emailed medical records.
