Our Brightpoint child welfare programs staff can tell us how financial insecurity triggers conditions – lack of a safe, consistent place to live; inadequate food; no dependable child care; fear of leaving a violent relationship – that are unsafe for children and their families. A growing body of research supports what we see: when families experience economic hardships, they struggle to provide safe and consistent care for their children and that leads to reports of child neglect. We know there is a relationship between economic instability and family instability, but we need to better understand that relationship. We need to untangle poverty from other causes of neglect. And we need to understand what types of interventions will prevent this instability from becoming abuse or neglect. White House Unveils New Policies to Transform Child Welfare The White House announced a series of new policies on Aug. 2 aimed at preventing family separation and creating opportunities for families and youth during a convening that brought together policymakers from federal, state, local, and tribal governments, along with leaders from philanthropy, child welfare, and family support organizations, and individuals with personal experiences in the child welfare system. The Biden-Harris administration demanded that children should not be separated from their families solely due to financial hardship. The event focused on encouraging innovation, building partnerships, and sharing best practices. One central area of focus is the distinction between poverty and neglect. Urge the United States Congress to act immediately to stop the reprehensible practice of forced family separation which affects hundreds of thousands of children and families annually. Not only do these families lose their vital connection to each other, they face ongoing trauma and abuse from the ‘System‘ that separated them. Call and write your United States Congress Members to demand that federals reforms are enacted to the US Child Welfare System to make state care a safe, nurturing, supportive, healthy, and happy environment. In light of the growing body of evidence that economic and concrete supports can keep children safely at home and prevent entry to foster care, more and more jurisidictions are building flexible funding into their child welfare prevention programs. While models vary, these interventions recognize that family needs differ, that they often require an urgent response, and that child welfare programs have a responsibility to ensure that poverty does not become the basis for more intrusive intervention in families’ lives. Calling all attorneys, judges, child welfare & DV Advocates who want to learn about best practices in cases involving domestic violence and children, this #ChildAbusePreventionMonth. Nicholson v. Scoppetta was a seminal New York state court decision that rose to the federal appellate level and established a critical legal framework for evaluating child abuse and neglect allegations in cases arising from exposure to domestic violence. The decision requires child welfare agencies to produce four categories of evidence when seeking judicial authorization to separate a child from the care and custody of a domestic violence survivor: 1) Imminent Harm 2) Parental Care 3) Individual Agency Support 4) Harm of Removal FUTURES has partnered with the National Center to Advance Peace for Children, Youth, and Families, the ABA Center on Children and the Law, and, most importantly, Sharwline Nicholson and other survivors of DV and the child welfare system to create this brief. This #ChildAbusePreventionMonth, we urge courts, advocates, and child welfare agencies to read and implement Nicholson's Four Factors to protect against children’s removal from a parent who has experienced domestic violence.
