It is appreciable that there is progress toward #LGBTQIA+ rights, but it surely must have an #Indian characteristic. Mimicking every other trend around the world might possibly show insensitivity toward deeply entrenched traditions and beliefs that society holds dear. A balance should surely be made so that changes coming in are baked and considerate of the sentiments of the wider #population. It is through incremental steps that further the changes of #understanding and dialogue, where LGBTQIA+ rights can be brought more appropriately to India's diverse #society. Sudden changes might cause resistance and backlash—undermining the very cause that activists are working towards

I recently represented a courageous 20-year-old male student, one of the few queer Indians, who faced sexual harassment and extortion during a Grindr date. His bravery in exposing these crimes sheds light on the alarming prevalence of sextortion cases associated with dating apps, such as Grindr, in our society. It is disheartening that victims like my client, who belong to the queer community, face such challenges. This case underscores the urgent need for legal reforms and a more inclusive approach to addressing crimes against individuals of all sexual orientations. India's Supreme Court decision to abolish Section 377 marked a monumental step for #LGBTQ+ rights, sparking hope and acceptance across the nation. This milestone wasn't just a legal triumph; it was a societal awakening that validated the existence and dignity of millions. The 2009 Delhi High Court judgment was pivotal in setting the stage for this victory. By decriminalizing consensual same-sex relationships, it challenged deeply entrenched prejudices and ignited a movement toward equality. Although temporarily overturned, it established a foundation for the Supreme Court's 2018 ruling that finally struck down the archaic law. These legal strides have empowered the LGBTQ+ community in #India, fostering a culture of inclusion, encouraging conversations, and challenging stereotypes. Yet, the journey continues toward full equality and acceptance. Since India's independence in 1947, queer people remained largely ignored until the 1980s and 90s, when a public articulation of queerness became prominent. By the 2000s, this public articulation had developed into a full-fledged movement for civil and substantive rights, which were partly achieved by the NALSA v Union of India judgement 2014, the Navtej Singh Johar v Union of India judgement 2018, and the legislative interventions that happened in their backdrop. Today, 77 years later, how far have queer and trans people come in becoming a part of the nation's citizenry and accessing all the rights promised constitutionally and otherwise? What is their sense of freedom? I am attempting to address these questions in my next report, and, as always, looking for queer people of different ages, and different castes, genders, sexual orientations, and disabilities to speak to. A significant step forward for queer rights in India! 🌈 Recently, the government issued advisories on several key areas: Ration Cards – Ensuring that queer couples are treated as one household, with no discrimination. Joint Bank Accounts – Clarifying that queer couples can open joint accounts and nominate each other without restrictions. Healthcare – Banning conversion therapy, making sex reassignment surgeries available, and ensuring the right to claim a partner’s body in case of death. Intersex Children – Providing guidelines to ensure healthy medical interventions for intersex children. While some may argue these steps don’t change the law, they address real discrimination faced by queer couples and provide much-needed clarity. At Meraki, we believe that progress is built on small victories. This advisory is a foundational step toward a future where every queer individual can live with dignity and equality. I'm thrilled to announce that I presented my paper titled "INCLUSIVITY - A FAR-FETCHED DREAM FOR THE LGBTQ COMMUNITY IN INDIA" where I answered a long pending question of- How far is India in achieving 'Inclusivity' in true sense? The 2030’s agenda for sustainable development goals focuses on “leaving no one behind”. It focuses on principles of inclusivity, equality and equity for all the nations of the world. The ideology behind inclusivity as a sustainable goal is that even those who are on the margins of the society should be included in the mainstream society. These are the people who are sidelined, ignored and often forgotten to be included in the intimate family functions, workplace or in any social gatherings of the society. Out of all the vulnerable and forgotten groups, LGBTQ community is the worst hit. Recently, in Supriyo @ Supriya Chakraborty & And. v. Union of India (Writ Petition (Civil) No. 1011 of 2022), the Apex court denied the legal recognition of same sex marriage. It held that right to marry is just statutory right & not fundamental right, and hence domain to create a law on same sex marriage would fall within the jurisdiction of the Parliament and judiciary has no role to create a law on the same.
