The “major questions doctrine,” formally embraced by a majority of the Court for the first time in West Virginia v. EPA, 142 S. Ct. 2587 (2022), requires administrative agencies to demonstrate “clear congressional authorization” when they assert authority over matters of “vast economic and political significance.” But what makes a question “major” or congressional authorization “clear”? I’m eager to read this book. There’s always more than one way to get something done but I’m interested to see the data related to how law and policy is being created. We know becoming an influencer is an actual job-title these days but what does that mean for how rules of governance is impacted and constituents are governed? This should also be an interesting discussion for anyone considering a career as a law and policy change agent. Knowing how things are or aren’t being achieved may be the conduit for creative solutions.
The 118th Congress passed fewer than 30 new laws in 2023, the least in decades. But that doesn’t necessarily mean U.S. representatives weren’t finding other ways to get things done. In a recent book, Associate Professor Melinda Ritchie uses newly uncovered data to explore how lawmakers work through federal agencies to accomplish their goals — without the necessity of passing laws.
